) ASLBP No. 93-671-01-OLA-3 INTERVENOR'S RESPONSE TO GEORGIA POWER'S NOTION FOR RECONSIDERATION For the reasons set forth below, Intervenor hereby supports the motion for reconsideration filed by Georgia Power Company.

The controlling regulation on this issue is 10. C.F.R.

S 2.759. Under this regulation, the Commission encourages parties to reach settlement of contested licensing issues. No review or approval of a settlement agreement is required by this regulation.

In this case, the parties have reached a confidential settlement which is conditioned upon the termination of this proceeding without issuance of a decision on the merits of the 9608140099 960802 j PDR ADOCK 05000424 C PDR

O underlying contention. Pursuant to this settlement, Intervencr is withdrawing his intervention and contention. Given the fact that intervenor is voluntarily foregoing his right to a hearing and further proceedings in this matter, the requirements of 42 U.S.C. S2239 are fully met.
