l Intervenor hereby requests an enlargement of time of five-working.  :

i days to file-his Post-Hearing Findings of Fact and Conclusions.of l Good cause exits for this-enlargement of time. Counsel for l Law.

Intervenor was required to litigate a hearing in Houston, Texas i

and a second hearing in Louisville, Kentucky during the time period in which they had to write the post-hearing brief. l 1

Counsel attempted to reschedule both of these hearings. In ]

addition, counsel needed to file a detailed brief on the enforcement conference regarding their client Mr. Marvin Hobby (see Board Notification 95-17) and counsel was required to engage )

in extensive negotiations with the Department of Justice and the  !

FBI in the representation of Dr. Frederic Whitehurst, a Supervisory-Special Agent at the FBI whose allegations are 9512060104 951121 DR ADOCK 050004 4

currently under review by the DOJ IG's office and the special

'" Blue Ribbon Commission". Finally, the counsel ~for Intervenor obtained a copy of the Secretary of Labor's order in the Department of Labor proceeding captioned Mosbauch v. Georcia power Comoany, 91-ERA-1 and 91-ERA-11.and a copy of the Nuclear

' Regulatory Commission's ruling on the Esther Dixon notes on November 21, 1995.. Counsel needs some time to study these two decisions. Given the size of the record in this proceeding, the disruptions in: counsel's schedule and the necessity to produce a useful and accurate post-hearing brief, good cause exists for a small enlargement'of' time. This is the first enlargement of time requested by the Intervenor for this post-hearing brief.

Counsel for the.Intervenor has discussed this motion with the parties to this proceeding. The NRC Staff has consented to the request, provided that the deadline for filing their brief be extended five working days. Counsel for Georgia Power opposes this request.

WHEREFORE, for good cause shown, Intervenor respectfully requests that the deadline for filing his post hearing brief be extended until November 30, 1995. In addition, the Intervenor agrees-to an equal enlargement of time in the filing dates for the brief of the NRC Staff and the reply brief of Georgia Power.
