  • ASLBP No. 93-671-01-OLA-3 i GEORGIA POWER COMPANY'S MOTION FOR ISSUANCE OF SUBPOENA Pursuant to 10 C.F.R. S 2.720, Georgia Power Company (" Georgia Power") moves the Licensing Board to issue a subpoena for the attendance and testimony of Mr. Mark Briney at the hearing on the diesel generator reporting issue. A subpoena for Mr. Briney is appended for signature.

Mr. Briney is a former Georgia Power Company employee at the Vogtle Electric Generating Plant ("Vogtle"). He was the acting Instrumentation & Controls superintendent at the Vogtle site following the March 20, 1990 site area emergency. He was also a member of the Event Critique Team that was chartered to investigate and advise the plant manager on recommended corrective actions learned from the site area emergency. Mr. Briney supervised the Calcon sensor calibration process and worked directly with the Vogtle General Manager in resolving diesel generator air quality issues which arose during the investigation and trouble shooting activities on the diesel generators. provide a complete record regarding Georgia Power's position on high dew points measured prior to the April 9, 1990 meeting with  !

.the Nuclear Regulatory Commission at the Region II offices in Atlanta, Georgia.

U.S.C. S 2201(c), and 10 C.F.R. S 2.720, Mark Briney is hereby ordered to attend and give testimony at the diesel generator reporting hearing in the above captioned proceeding. A mutually agreeable time shall be arranged for such attendance and testimony.

Presently, the rebuttal phase of the hearing is scheduled for August 8-11, 14-17, and 22-25 in Augusta, Georgia.

On motion made promptly, and in any event received on or before August 11, 1995, and on notice delivered to Georgia Power Company on or before that date, this Atomic Safety and Licensing i

Board (or if the Licensing Board is unavailable, the Commission) may (1) quash or modify the subpoena if it is unreasonable or i requires evidence not relevant to any matter in issue, or (2) condition denial of the motion on just and reasonable terms. A l
