Summary of NRC Investigation 1-2003-017

Dear Mr. Dacimo:

The Region I Field Office of the NRC Office of Investigations (OI) initiated Investigation 1-2003-017 on February 14, 2003, to determine whether IP2 licensed operator applicants had not completed their required qualification manuals as part of the licensed operator applicant training program, yet signed their Personal Qualification Statements (NRC license applications) in June 2001 certifying that they had completed their training programs. If the applicants had deliberately signed the license applications knowing that they had not completed the qualification manuals, this would have constituted the provision of false information to the NRC.

Based upon information learned during the OI investigation, it was apparent that Entergy was aware that similar concerns had been raised internally via the corrective action program. While deficiencies had been noted in some individual qualification records, OI identified that the "Operations Qualification Guide Format" was an Indian Point administrative document and was not required to be signed off as complete prior to the operator license candidate signing the NRC Form 398/Personal Qualification Statement. Entergy characterized the identified deficiencies as examples of not meeting station expectations for the quality of qualification records. OI found Entergys characterization to be plausible based on review of the candidates' qualification guides, coupled with interviews of the license candidates, which did not indicate any specific instances of falsification or deficiency that would call into question the validity of their license applications.

OI review of the qualification guides also revealed that Indian Point Operations and Operations Training management had reviewed the Operations Task List during the course of the training class and made decisions to modify or delete a number of specific individual qualification tasks, which was allowable under Indian Points accredited operator training program (which is based upon a Systems Approach to Training (SAT)). Key card entry/exit records reviewed by OI further indicated that the candidates were physically present in locations on the dates that they claimed training occurred and was completed. Additionally, interviews of the license candidates CERTIFIED MAIL RETURN RECEIPT REQUESTED

Mr. F. Dacimo 2 RI-2003-A-0016 RI-2003-A-0026 revealed that each had valid explanations for how and when they obtained their training qualification guide signatures for On-the-Job Training and On-the-Job Evaluation. OI found no evidence to contradict those explanations.

Based on the evidence developed during this investigation, OI did not substantiate that any of the 2001 licensed operator applicants had not completed their training program requirements.

Therefore, the NRC did not substantiate that any of the license applications constituted the provision of false information to the NRC.
