Dear Mr. Baxter:

Your e-mail (below) came to my attention. I am the NRC Project Manager for Nine Mile Point.

Tommy Le, our Project Manager for Nine Mile Point License Renewal, had told you that your concern is not under the purview of license renewal, but is under the current operating reactor project management program. Let me affirm the accuracy of this statement.

We have discussed your concern with the licensee, and the licensee submitted a letter on November 10, 2004, to address this issue. You may find this letter under Accession No. ML043280420 in NRC's public document system. The NRC staff has been reviewing that letter on a schedule based on the safety significance of the issue. Our tentative target date to issue a Safety Evaluation of this issue is April 2005.

Please note that I am your sole contact at NRC regarding this issue. Should the review schedule change, or we need more information from you, I shall contact you. Otherwise, rest assured that we are still on track and on schedule to complete this review.

You did not request that your e-mail (below) and one dated 9/19/04 (attached, Accession No. ML043230428) be withheld from public disclosure. Accordingly, unless you provide appropriate reason to withhold these two e-mails, I shall put them in the public domain by January 7, 2005.

On September 18, 2004, I submitted some safety concerns related to the Nine Mile Point License Renewal application, where I identified that Nine Mile Point did not meet applicable NRC regulations.

On October 18, 2004, I wrote to inquire the status and disposition of my comments.

On October 27, 2004, I received a phone call from Tommy Le indicating that the concerns I had raised were outside his area of expertise, and had been directed to another department for review and resolution.

It is now three months since submittal of my comments, and I have yet to hear how the safety concerns identified have been addressed and dispositioned.
