ASSESSMENT FOLLOWUP LETTER FOR THE PERRY NUCLEAR POWER PLANT AND DEVIATION FROM THE REACTOR OVERSIGHT PROCESS ACTION MATRIX
Dear Mr. Kaminskas:
In its semi-annual performance review letter dated September 4, 2012 (ADAMS Accession Number ML12248A312), the U.S. Nuclear Regulatory Commission (NRC) informed you that performance at the Perry Nuclear Power Plant (Perry) was within the Degraded Cornerstone Column (Column 3) of the Action Matrix of Inspection Manual Chapter (IMC) 0305, Operating Reactor Assessment Program. The NRCs evaluation consisted of a review of performance indicators and inspection results, including one or more Greater-than-Green findings in the Security Cornerstone, and a low-to-moderate safety significance (i.e., White) inspection finding and Notice of Violation (NOV) and a White Occupational Exposure Control Effectiveness Performance Indicator (PI) in the Occupational Radiation Safety Cornerstone.
The NRCs inspection of the security issue was documented in a letter to you dated October 25, 2012 (ML12300A061). To evaluate your response to the issues in radiation safety, the NRC conducted a supplemental inspection pursuant to Inspection Procedure (IP) 95002, Inspection for One Degraded Cornerstone or Any Three White Inputs in a Strategic Performance Area, at Perry from August 27 through November 16, 2012. NRC Inspection Report 05000440/2012009 (ML12363A137), issued on December 28, 2012, documented that inspection and discussed the need to open a parallel White PI inspection finding and hold open the previous White finding and NOV. As discussed in that report, a follow-up 95002 inspection will be conducted to address your corrective actions.
Because of the two radiation protection White findings and the one or more Greater-than-Green findings in security, Perry meets the definition in IMC 0305 for Multiple/Repetitive Degraded Cornerstone, Column 4, of the Action Matrix. However, because current performance issues are well understood and appear to be limited to occupational radiation safety, at present, the regulatory actions specified for Column 3 of the Action Matrix are more appropriate than those specified for Column 4. Consequently, the NRCs Executive Director for Operations has approved a deviation from the Action Matrix for Perry.
V. Kaminskas The NRC is deviating from the Action Matrix by maintaining Perry in the Degraded Cornerstone Column, Column 3, and not moving it to the Multiple/Repetitive Degraded Cornerstone Column, Column 4, and not conducting the associated 95003 supplemental inspection. This deviation is effective as of January 11, 2013.
As documented in the approved deviation request (ML13004A403), the deviation will be closed and Perry will move to Column 4 if: 1) the follow-up 95002 inspection, scheduled for completion in the May-July 2013 timeframe, identifies a significant weakness in Perrys performance; 2)
Perry is unable to complete corrective actions necessary to permit the follow-up 95002 inspection to be completed before the end of July 2013; or 3) if another Greater-than-Green PI or finding is identified (other than a change of color for the current Occupational Exposure Control Effectiveness PI issue).
