ORDER (Denying Request to Livestream Oral Argument)

On December 13, 2018, the Board received an ex parte communication from the Commission Chairman of the County of Eddy, New Mexico.1 This communication, attached, requests that the Board make arrangements that will allow the County to livestream the oral argument on standing and contention admissibility in Albuquerque, New Mexico on January 23-24, 2019.2 On September 13, 2018, Eddy County submitted a petition to participate in this proceeding as an interested local governmental body. The petition stated: As required by 10 C.F.R. § 2.315(c), Eddy County designates Rick J. The County is reminded of the requirement to file and serve communications on all participants through the NRCs E-Filing system,4 and of the requirement to participate through a single representative.

With respect to the request to livestream the oral argument, the County is further reminded that, by Order of November 7, 2018, the Board requested the participants positions regarding the location of oral argument. In accordance with the stated preference of many participants that responded, the Board determined to conduct oral argument in Albuquerque, New Mexico, and made arrangements to use the federal court facility there.5 The Board will comply with the local rules for the federal court, which prohibit video and audio recording and photography in the courtroom.

Eddy Countys request for livestreaming is therefore denied.

The County of Eddy respectfully requests that the Atomic Safety and Licensing Board

("Board") make arrangements that will allow the County to livestream the oral argument on COUNTY MANAGER standing and contention admissibility in Albuquerque, New Mexico on January 23-24, 2019.

Rick J . Rudometkin ASSISTANT COUNTY MANAGER Albuquerque, NM is over 200 miles away from the County and the Holtec site, which is Kenney Rayroux a driving distance of four to five hours. As a result, few, if any, of our interested constituents will be able to attend the oral argument. Holding the oral argument so far from our community, which is only 35 miles from the Holtec site, does a disservice to those members of our community who are interested in the Holtec facility.

ELECTED OFFICIALS Gemma Ferguson In light of the Board's decision to hold the oral argument in Albuquerque, the County Assessor requests that the Board make the necessary arrangements to broadcast the oral arguments Robin Van Natta such that the County can livestream the proceedings in its Commission Chambers at 101 W.

Clerk Greene Street, Carlsbad, New Mexico 88220. The Commission Chambers can accommodate John Caraway Probate Judge up to 50 and an additional 25 in an overflow area, who would be able to watch the proceedings.

While holding the hearing locally would have been preferable, a livestream will at least enable Mark Cage Sheriff our community to be involved in the hearing process.
