ORDER (Denying All Livestream Requests and Reminding Participants of Service Requirements)

As reflected by the attachments to the NRC Staffs Board Notification,1 as well as a recent letter from the Mayor of the City of Hobbs, New Mexico,2 the Board continues to receive ex parte requests to livestream the oral argument set for January 23-24, 2019 in Albuquerque, New Mexico. Collectively, the requests seek livestreaming to the Eddy County Commission Chambers, the City of Hobbs Commission Chambers and/or the City of Carlsbad City Hall.

The Eddy-Lea Energy Alliance (the ELEA), which did not respond to the Boards Order requesting the participants views on where to conduct the oral argument, expresses confusion as to the Boards choice of Albuquerque.3 At the oral argument, the Board will address the 1 NRC Staff Board Notification (Dec. 20, 2018) (hereinafter Board Notification).

petitions of eighteen organizations that assert standing based on residences in seven different states. Twelve of them timely responded to the Board by asking that the argument be held in Albuquerque.

The ELEA also advises that, notwithstanding the local rules of the United States District Court in Albuquerque, the Chief Judge and Chief Clerk could possibly allow livestreaming if the Board requests it.4 The Board appreciates the hospitality of the District Court and declines to request an exception to its rules. The scheduled argument will consist primarily of the Boards questions to counsel concerning specific aspects of the hundreds of pages of pleadings we have received. A complete written transcript will be available on the NRCs public website a few days after the arguments conclusion. Although the public is welcome to attend, it will not be an opportunity for public participation; nor will it materially differ from numerous legal arguments in matters of public interest that no doubt take place regularly before the Judges of the District Court. The oral argument does not, in our view, present any good reason to request an exception to the Courts usual practices.

The requests for livestreaming are denied. All participants are again reminded of the requirement to file and serve communications with the Board through the NRCs E-Filing system.5 It is so ORDERED.
