Footnote 33 erroneously refers to a section that is not included in the memorandum and order. Accordingly, the following sentence and citation shall be stricken from footnote 33: Holtec challenges the Boards ruling on Faskens standing as well, which we discuss in section II.F.1 below. See Holtec Opposition to Fasken Appeal at 14-19.
