As previously ordered,1 the Board will hear oral argument concerning Faskens pending motions,2 by telephone, on Wednesday, August 5, 2020, commencing at 1:00 PM EDT.

In addition to being prepared to respond to the Boards questions on any aspect of the pleadings, the participants may expect to address the following questions:

1. Fasken contends that it seeks leave to file Amended Contention 2 to contest newly disclosed and highly pertinent information, as well as material omissions, inadequacies and inconsistencies contained in Holtecs licensing application documents....3 Does Fasken dispute that, at this time, it may challenge alleged deficiencies in Holtecs licensing application documents only on the basis of newly disclosed information?

2. Fasken contends that inaccurate and inconsistent statements in Holtecs application lead to faulty premises and conclusions in the NRC Staffs DEIS.4 Does Fasken dispute that, at this time, it may challenge alleged inaccuracies in Holtecs application only on the basis of newly disclosed information?
3. Fasken contends that statements made for the very first time in the recent DEIS in fact continue to misrepresent the control and ownership of subsurface mineral rights, the status of industry operations, and geologic characteristic in the region of the proposed Holtec CISF project.5 Does Fasken claim that statements in the DEIS are based on alleged misrepresentations in Holtecs licensing application documents? If so, does Fasken dispute that, at this time, it may challenge alleged misrepresentations in Holtecs licensing application documents only on the basis of newly disclosed information? Or does Fasken claim that repetition in the DEIS, without more, entitles Fasken to challenge alleged misrepresentations in Holtecs licensing application documents that Fasken did not challenge when hearing petitions on Holtecs license application were initially due?
4. Does Fasken claim that its Amended Contention 2 raises an exceptionally grave issue as that term is used in 10 C.F.R. §2.326(a)(1)?

The participants may address these matters in their opening statements or may wait for the Boards questions, as they prefer.

Finally, the participants should arrange to have access to the DEIS during the Boards questions. Portions that are likely to be the subject of questions include Figures 2.2-2 and 3.2-4.
