New Haven 1 and 2 ) October 1, 1979 To: Atomic Safety and Licensing Board Euclosed plase find Ecology Action of Oswego's revised contentions, completed following converstions and meetings with the NRC Staff lawyers.

We regret the fact that the taxpayers had to pay for the time spent by the NRC lawyers on this case, and on the travel to Oswego for these lawyers last month to discuss the contentions, because the application was not yet dismissed. We fully expect that Case 8000A wil be dismissed on Oct. 12, 1979.

We would like to bring to the Atomic Safety and Licensing Board's attention our filing of July 27, 1979, where we stated:

"Since LILCO is clearly not a viable co-applicant, the Atomic Safety and Licensing Board must follow immediately the lead of the Public Service Commission (of July 10, 1979) and dismiss the case before any more time and money is spent on a nonviable application" (pp. 2-3).

We again request the prompt dismissal of Case Docket No. STN 50-596-597.
