l 1 In response to the Order of the Atomic Safety and 2 Licensing Board dated December 22, 1980, Applicant 3 supplements its Answers to Intervenor's First Set of 4 Interrogatories as follows:

5 6 FURTHER ANSUER TO INTERROGATORY NO. 4 7

8 Applicant previously answered this interrogatory

9 by stating that the " function" of the Research Reactor is 10 education. While this remains true, Applicant will make 11 available, pursuit to Rule 33(c), Federal Rules of Civil 12 Procedure, its financial and accounting records which 13 include, the operations of the Research Reactor which are 14 relevant to this interrogatory. (See letter of January 19, 15 1981, Attachment A hereto.)

16 17 FURTHER ANSUER TO INTERROGATORY NO. 5 18 19 As previously indicated in its answer to this 20 interrogatory, Applicant is unable to secure the information 21 from its files to be able to categori=e the income derived 22- as requested by this interrogatory. Nevertheless, Applicant 23 will agree to make available its financial and accounting 24 records of NEL income as set forth in Attachment A hereto.

i 10 gg FURTHER ANSUER TO INTERROGATORY NO. 9 12 13 As indicated previously, there is no functional 14 categorization of reactor operating time prior to 1971.

15 Bginning in 1971, reactor operating time was categorized 16 into three functions: (1) maintenance, (2) classroom 17 instructions, and (3) research. As stated in the previous 18 answer, the financial and accounting records with respect to 19 these categories and within that time frame will be made 20 available to Intervenor at its request. (See also 21 22 23 I

RE: NRC ORDER GRANTING MOTION TO COMPEL FURTHER ANSWSRS TO INTERVENOR'S FIRST SET OF INTERROGATORIES (DECEMBER 22, 1980)

Dear Mr. Pollock:

Pursuant to the order of the Atomic Safety Licensing Board issued December 22, 1980, and in response to your letter of December 30, 1980, the University is prepared to make available for Intervenor's examination financial and accounting records relevant to questions 4, 5, 6 and 9 of Intervenor's First Set of Interrogatories.

In our telephone conversation of January 6, 1981, we agreed generally to the following procedures.

The custodian of records and the individual charged with responsibility for accounting for the Nuclear Energy Laboratories is Accounting Officer Edward Smith. Mr. Smith can be reached by telephone at 825-7501. Mr. Smith will make available to you copies of those pages of the University's general ledger which contain the accounting entries for the NEL

" income account" for the period July 1,1975, through June-30, 1980. In addition, at the time you appear to pick up the. general ledger sheets, Mr. Smith will inform you on how to interpret the notations appearing on the ledgers. Af ter you have inspected the general ledger, if you wish to inspect any source document, you should provide the accounting office with a single list of the source documents (identified by invoice or voucher number) you wish to examine. Notations can be c 'de on the ledger sheets themselves which can then be returned to the accounting office.

Within a reasonable time the accounting office will be able to retrieve the records requested. The retrieved records will be copied and sent to you, or you may pick them up at the accounting office.

The University's offer of financial and accounting records is made in accordance with Rule 33 (c) , Federal Rules of Civil Procedure.

If you have any huestions regarding these procedures please call me; otherwise, you may contact Mr. Smith directly to arrange for review of the general ledger sheets.
