i DECLARATION OF NEILL C. OSTRANDER I, Neill C. Ostrander, say:

1 I am employed by the University of California as Manager of the Nuclear Energy Laboratory (NEL) and have been in this position i since September 1974.

2. I am responsible for the day to day operation of the NEL and the j supervision of the staff which operates and maintains the reactor, l maintains the records and administers to the needs of the students who use the facility.
3. I maintain a chronological file of those legal documents forwarded to me by Mr. Cormier which pertain to the license renewal litigation, that I do not routinely review these documents, nor do I routinely _
circulate or copy these documents for distribution to other members of the NEL Staff. -
4. With respect to the August 25, 1983 and the December 13, 1983 documents of Mr. Cormier, and to which the Board Order of 8405040011 840501 PDR ADOCK 05000142 G PDR l

l April 13,1984, refers , I did not review those documents either before or after they were submitted. I do not recall that I read the documents at any time prior to the time the Board raised the question of a possible misrepresentation in its recent order. Also, I did not ask any other member of my staff to review those documents either before or after they were submitted.

5 With regard to the response procedures enumerated in item 3 of

, the Board's Order of April 13, 1984, I can provide the following information. I supervised and participated in the preparation.of the NEL Emergency Response Plan (ERP) and the Emergency Procedures which implement that plan. (The ERP appears as Appendix IV of the UCLA License Renewal Application, and was submitted as an amendment to that 4

l Application in July, 1982.) Selected portions of the ERP and Emergency i

l Procedures have been filed with the security plan for use and reference a purposes. With reference to the specific procedures enumerated in i Appendix B of the Board's. Order, I identify the following:

- Item "a)" -- Emergency Classification Guide: this is a copy of Table II, ERP, with the " Table II" description deleted. This Guide appears on page IV/5-2 of the UCLA Application.

- Item "b)" - "4.2 Emergency Director's Guide, 4.2.1 Bomb Threat" is a reproduction of ERP - Procedure "4.2.1 Bomb Threat" for dealing with bomb threats in a manner consistent with ' general campus procedure, . The Bomb Threat Check List is a compact form of the same material presented on five consecutive pages of the j

UCLA Campus Emergency Plan, which containsthe general response procedures for the campus.

- Item "d)" - "F Civil Disorder" is a reproduction of ERP -

Procedure "4.2.2 Civil Disturbance".

- Item "e)" - "G. Fire or Explosion" is a reproduction of ERP -

Procedure "4.2.5 Fire or Minor Explosion"

6. The foregoing procedures were developed in the context of emergency management, and in particular to implement the ERP. The three procedures above were adopted in March 1983. 'These procedures and several others are specifically called for in the ERP (page IV/ll-1 of the UCLA License Renewal Application). These procedures were not developed solely or even principally with either prevention or detection of radiological sabotage in mind. To the extent that they deal with the consequences of either accidental or deliberate releases, they are applicable to the mitigation of such consequences. They were not written to respond to any specifically defined sabotage-threat.
