Introduct*cn 14 On January 9,1984, CBG filed a Motion for Curtailment 15 ("Irrsparable Injury Associated With Any Further Delay.") On January 17, 16 Applicant requested a 3) week delay in responding to said motion.

17 CBG has no objection to a reasonable extension of time, but opposes the 24 18 day request as excessive.

19 20 II. Discussion j 21 The Curtailment Motion in question did not come as a surprise

' to Applicant. The Motion had been explicitly solicited by the Board and 22 23 CBG had put the parties on notice that it would be forthcoming.

24 It is recognised that the issues rai sed in the Motion are very 25 serious. We have indicated that we believe the Board's decision on this 2G Motion may be the most important decision to date in this long proceeding.

27 Adequate time for response is reasonable.

l 1 the rules seems unreasonable, particularly given the advance notice.

2 There is some irony in a request for such a long delay in responding to a 3 action alleging dilatory behavior.

4 CBG continues to believe a decision by the Board on thia matter 5 by February 15 is essential. Any extension of time for Applicant to g respond that would still permit sufficient time for the Board to make 7

its ruling would be acceptable to CBG, but obviously a rebruary 16 g response date for UCLA would occasion a significant delay.

g CBG does not oppose a one or two week extension of time for 10 Applicant, but respectfully suggests tnat the 24-day request is excessive gj and wculd cause further needless delay in a proceeding where delay has serious ramifications for public health and safety.
