1. My name is Donald J. Kasun. I am Section Leader of the Reactor Safeguards Licensing Section in the Division of Safeguards in the Office of Nuclear Material Safety and Safeguards, of the Nuclear Regulatory Commission.
2. I have read the questions in the Licensing Board's Memorandum and Order dated October 16, 1985 regarding the settlement agreement among the parties to the p-oceeding.

, 3. I will respond to the concern about safeguards expressed in l

l question 3 of the Memorandum and Order about the effect of the release l

of the UCLA security plan to the public on the security of other nonpower reactors which might have similar plans,

4. There are currently no NRC regulations or requirements prohibiting operators of nonpower reactors from disclosing information in the facility security plan after the special nuclear material has been removed from the site.

5. It is not clear to the safeguards staff what harm, if any, to i

the security of other nonpower reactors might stem from the release of the UCLA security plan. On the other hand, it is probable that a sufficient technical case could not be developed on the basis of a single plan to support either a Commission Order or a rule change.

6. On the basis of the above, the staff does not object to i

Section 3 of the settlement agreement regarding access to the UCLA plan.
