NRC INSPECTION REPORT 70-925/94-01 This letter refers to the inspection conducted by Messrs. R. J. Evans and C. L. Cain of this office on November 17 through 18, 1994. The inspection included a review of activities authorized for your facility. At the conclusion of the inspection, the findings were discussed with you and those members of your staff identified in the enclosed report.
Areas examined during the inspection are identified in the report. The inspection primarily consisted of a review of facility status, management and organizational structure, and the radiation protection program. Within these areas, the inspection consisted of selected examination of procedures and representative records, interviews with personnel, and observation of activities in progress. The results of this inspection are documented in the enclosed report.
As you are aware, inspection oversight for the Cimarron facility was recently transferred from the NRC Region III office to the NRC Region IV office. As part of this change in inspection responsibility, the Cimarron facility docket files were transferred to Region IV from Region III. (The Regional files are generally duplicates of files that are maintained at the NRC Headquarters file room.) The Cimarron files were recently sorted into two docket files, one for License SNM-1174 and the second for License SNM-928. Since License SNM-1174 was terminated by the Commission, we plan to ship this docket file to the NRC's archives in the near future. License SNM-928 docket files will remain in this office until the license is terminated by the Commission.
During the docket file review, documents were found with markings indicating that the documents may contain information which is exempt from public disclosure under the provisions of 10 CFR 2.790. The documents fall into four basic categories: (1) material accountability reports, (2) the security plan and associated security-related inspection reports, (3) process and production procedures and drawings, and (4) allegations, including original allegations submitted to the NRC and allegation followup reports.
The NRC Region IV office has decided that, to the extent any such documents were exempt from disclosures, the files should now be released from the 10 CFR 2.790 restriction because your facility has been dismantled, the facility is exempt from the requirements of 10 CFR 70.24 (criticality accident requirements), and the facility is in the final stages of decommissioning.
Additionally, the security plan and material control plan requirements were terminated by the NRC on April 4, 1988, for the SNM-1174 license. It is our understanding that the security plan was not applicable to the SNM-928 9501310125 950120 PDR ADOCK 07000925 C PDR

Allegation-related records will be handled in accordance with NRC Management Directive 8.8. If you object to our decision to lift the 10 CFR 2.790 restrictions on the Cimarron documents, then you should inform us of your concerns within 60 days from the date of this letter and we will review those concerns consistent with the requirements of Section 2.790.
During this inspection at the Cimarron facility, you stated that you would like to send a representative from Kerr-McGee to review the Cimarron files in the Region IV office. Please coordinate such a visit with Mr. C. L. Cain of this office so a visitor escort can be assigned.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be placed in the NRC Public Document Room.
