INTERVENOR'S RES~0NSE TO CECEMBER 20. 1979. ORDER The1SLS Board's order of December 20, 1979, directed a res;;cnse to Aoplicant's motion 'or disnissal (IE-17-79) and directed censideration of the Staff's response.

Intervenor filed a res;;cnse to Acolicant's motion on Cec. 14, 1979, and feels that this respcnse adequately addresscl the matter of pre-fil ed testimony.

The remaining concern is the intervenor's lack of res;:ense t0 the Scards Aucun

• 6,1979, memorandum and crder directing parties to report to the Scard their recc mendations on hcw to proceed with the deliberate and timely consideration of issues in this matte . Intervenor sup;:orted the staff's reS;.cmendations as put forth in the staf#'s respense, September 9, 1979, and had no further precosals for the resolutien of cutstanding contentions. De staff notes that centention 9 is tne only centention amenable to consideration orier to the comoletien of the ES and SER.

As this cententton rega.ds the cuality of constructicn that is still w progress, it seems untimely to dispose of this contentien prior to the ccm::letion of constructicn.

Should the Scard wish to have a secerate hearing to resolve cententien 9, the inter-vence recuests 30 days notice of such hearings.
