REQUEST FOR LEAVE TO FILE STATEMENT IN SUPPORT OF FAIRFIELD UNITED ACTION APPEAL Tne regulations of the Nuclear Regulatory Commission do not provide for the filing by non-parties of anicus briefs or statements in support of appeals taken by parties to licensing proceedings.

The South Carolina Chapter of the Sierra Club thus requests leave to file the attached statenent in support of the intervention of Fairfield United Action pursuant to the Nuclee.r Regulatory Commission's general authority to resolve appeals of Appeal Board decisions.

The Sierra Club is a nonprofit corporation organized in 1892 and existing under the laws of the State of California, with its principal place of business in the City and County of San Francisco. The Sierra Club is a national conservation organization of more than 230,000 members, of whom approximately 1,048 are members of the South Carolina Chapter. The Sierra Club was organized to study, protect, enhance and enjoy natural resources and a clean and healthy environnant. *3

-s The-Sierra Club, and particularly the members of the South f Carolina Chapter, have an interest in the licensing and operation of the V.C. Summer nuclear plant. Members are concerned that the

' issues of the' competence to operate the facility and the efficacy of emergency planr,1xe fully explored before a license is granted. They are als'c: cnncerned that citizen groups, such as Fairfield United Action, have the opportunity tc participate in the licensing proceedings when, as the Licensing Board determined was the case here, their participation will contribute to the record and will not unduly delay the proceed!ngs.
