NRC STAFF RESPONSE TO APPLICANT'S MOTION FOR RECONSIDERATION INTRODUCTION On July 30, 1982, the Applicant filed a motion for Board reconsideration of certain passages in its July 20, 1982 Partial Initial Decision (PID) in this proceedingIl wherein it is suggested that either the Applicant or Staff or both did not report certain accelerometer records, furnished by both parties in October 1981, to the Board on a timely basis. This suggestion is erroneous and should be eliminated from the decision.

demonstrate, unprocessed U.S. Geological Survey (USGS) accelerometer records of an October 1979 seismic event at Monticello Reservoir were not made available to the Staff until October 9, 1981 by the Applicant, to whom they had just been provided directly by the USGS. The Staff had a standing request for any such relevant records but did not learn of the existence of the records in question until this time. As explained in BN-81-32, though it knew of the occurrence of the October 1979 seismic event, the Staff had no reason to expect the range of peak acceleration values eventually associated with that event since the higher magnitude August 1976 event yielded lower peak acceleration values. The Staff did not learn of the peak acceleration values for the 1979 event until provided with the associated USGS accelerometer records on October 9, 1981 after which the Staff promptly notified the Board and parties in BN-81-32 of the peak acceleration values and the possible implication of such values in the case. The Board's intimation that the information in this record was known by and available to the Staff beforehand is incorrect and should be removed from the PID. Accordingly, the Staff supports the Applicant's request that portions of the July 20, 1982 PID suggesting that the Staff and Applicant failed to report these accelerometer records in a timely manner be stricken from the PID.

o III. C0fiCLUSION In light of the foregoing, the Staff joins the Applicant's request to reconsider passages in the PID regarding Board notification of the above-rdferencedaccelerometerrecords.
