APPLICATION FOR STAY OF DECISION PENDING REVIEW

For the reasons stated in the " Application f r Stay of Decision Pe:rding Review," filed June 5, 1981, with the Atomic Safety and Licensirg Appeal Board, Fairfield United Action (FUA) hereby applies for a stay of the effect of the Appeal Board's decielon, ALAB-642, 13 NRC (June 1, 1981), reversing LBP-81-11, 13 NRC (April 30, 1981), pursuant to 10 CFR Section 2.788, in order that FUA may go forward in the evidentiary hearings set to corrm.;nce June 22, 1981, at its own risk, pending a final decision oof the merits on review.

FUA received telephone notice f rc m the Appeal Board's Secretary on June 15, 1981, that the Appeal Board had, that day,. denied FUA's Application for Stay and had forsarded copies of FUA's Application for Stay and the Appli-cants' and Staff's Answers thereto, for considerrtion by th9 Commission.

On June 15, 1981, FUA filed its Petition for Review with the Commission requesting expedited consideration and entry of an order admitting FUA as an Intervenor in these proceedings.
