JOHN RUOFF'S MOTION FOR RATES AND CHARGES

CONTINUANCE On May 12, 1981, Intervenors Fairfield United Action ("FUA")

and John C. Ruoff filed a Motion for Continuance in this Docket.

At the same time, John C.

Ruoff, as designated representative of FUA, which is an Intervenor in Nuclear Regulatory Cormission Docket No. 50-395 OL, filed a similar motion seeking' identical relief in that proceeding.

A copy of FUA's Motion for Continuance in the NRC docket, withoac attachments, is attached (Appendix A).

The Motions in this Docket, as well as the NRC Docket, recite the fact that the schedules of both proceedings overlap for the weeks of July 13-24.

This fact, along with the fact that Robert Guild, Esquire, who has now entered an appearance in the NRC Docket on behalf of FUA, represents South Carolina Welfare Rights Organi-

ation, another Intervenor in these proceedings, are claimed to pose a probability of prejudice to the interests of Intervenors John C.

Ruoff and FUA.

On May 18, 1981, the Atomic Safety and !icensing Board of the NRC, in Docket No. 50-395 0L, issued an Order giving FCE&G until one day after filing its response in the Public Service Commission Docket, to file its response in the NRC Docket.

I A copy of that Order is attached (Appendix B).

i Under the circumstances, giNen the absolute need to maintain the current licensing schedule for the V. C. Summer Nuclear Plant, South Carolina Electric & Gas Company joins in the request that hearings in this Docket be continued until after July 24, 1981.
