Dear Dr. Lipoti:

This letter is in response to your letter to me dated April 17, 2008, regarding the Oyster Creek Cumulative Usage Factor Analysis. Specifically, you expressed concern that the results of the analysis be "thoroughly documented and disclosed in a manner that will permit public review and understanding." You also recommend that the Oyster Creek docket contain a lengthy and thorough presentation of the issues.

As you are aware, the NRC staff advised the Commission and other stakeholders of the situation regarding the use of a simplified analysis tool as soon as we became aware that there was a potentially non-conservative aspect to the program. The specific concern was that a simplified analysis strategy was used (use of one stress component to represent six stress components), and that the staff wanted to ensure that this simplified strategy was sufficiently conservative. The NRC asked the applicant for a reanalysis using the six stress components and on April 29, 2008, the staff issued a Request for Additional Information (RAI) to AmerGen regarding their use of Fatigue-Pro. The staff also requested that AmerGen verify that the reactor recirculation outlet nozzle was the only location where the simplified calculation was applied. This document is publicly available in the NRC Agencywide Documents Access and Management System (ADAMS) under Accession No. ML081080077. On May 1, 2008, AmerGen responded to the RAI with a summary of the analysis that had been conducted. The AmerGen document is publicly available in ADAMS under Accession No. ML081270386. Copies of the AmerGen response were provided to members of your staff by the NRC Project Manager for Oyster Creek license renewal.

To document our review of the reanalysis, we plan to document (in a publicly available supplement to the safety evaluation report) our evaluation of the fatigue analysis consistent with what we wrote in a similar safety evaluation report on this topic.
