Contrarytotheabove,onJanuary24,1991,theinspectordeterminedthatthelicensee'scollectionsitestaffwasnotmaintaining,inthePermanentRecordBook,identifyingdataoneachspecimencollectedatthecollectionsite,inthesequenceofcollection.Onlycontractorpersonnelspecimencollectionswerebeingenteredinarecordbook;licenseepersonnelspecimencollectionswerebeingmaintainedinacomputerbasedrecordssystem.ThisisaSeverityLevelIVViolation.(SupplementVII)REPLYTTHEVILATIN1.ThRnfrhVilinRochesterGasandElectricCorporation(RG&E)concursthatthestatedviolationoccurred.Since.developingtheFFDprogram,acomputerizedsystemfortrackingeachindividualtested,includingcontractoremployees,hasbeenmaintained.Thiscomputerprogramcould,ifnecessary,printalistinchronologicalorder.Wealsoretainedacopyofeachchain-of-custodyformtouseasarecordsignedbytheemployeebeingtested,whichlistedallinformationidentifyingthespecimens.Webelievedthatthecombinationofthecomputerizedtrackingsystemandacopyofthechain-of-custodyformwouldadequatelyserveasapermanentrecord.2.ThrrivThHvBknThR'AhivRG&Epurchasedthree(3)permanentlyboundbooks,oneforeachcollectionsite.TheSiteCollectionOfficerenterstheidentifyinginformationoftheindividualtestedandspecimencollectedandtheindividualsignshis/hername.'esultsofthisactionassurethatapermanentrecordbookisinplaceateachcollectionsitetoaccountforallemployees,includingcontractoremployees,ofthetestsperformedandspecimenscollectedwithidentifyinginformation.3.1vWillBTknTAviFhrVi1inOnMarch1,1991,theRG&EFitnessForDutyProgramProcedureswereimplementedasacontrolleddocumentanddistributedtokeypersonnel.TheprocessforutilizingthepermanentrecordbookisincludedinprocedurenumberFFD-9titled,"CollectionProcessandChainofCustody."

ThDWhnF11mlinWillBivFuHcompliancewith10CFRPart26,AppendixA,SubpartB,Paragraph2.4,"SpecimenCollectionProcedures,"Subparagraph(g)(24)wasachievedonJanuary24,1991.Onthatdate,thepermanentrecordbookwaspurchasedandtheprocessforenteringtherequiredinformationwasactivated.2441--TETINFEMPYEEWITHINFRENTITEAEAllemployeeswhohaveinfrequentaccesstothesitearecoveredbytheCompany'sFitnessForDutytestingprogramandmustadheretoallprovisionsofthecorporateDrugandAlcoholAbusePolicy.Therefore,wedonotbelieveanyadditionalpoliciesorproceduresarenecessary.However,RG&Ehasdevelopedaninterimpracticefortestingofnon-RG&Epersonnelwithinfrequentsiteaccess.Wearecurrentlyusingthisinterimpracticeforatrialperiodtoassistusindeterminingthebestmethodforreachingtheseindividuals.Basedontheresultsoftheinterimpracticeduringthistrialperiod,anapprovedprocedurewillbeimplementedandincludedintheRG&EFitnessForDutyProgram.Verytrulyyours,RobertC.Mecredy~ICMr.ThomasT.MartinRegionalAdministratorRegion1475AllendaleRoadKingofPrussia,PA19406Mr.ThomasMoslakUSNRCSeniorResidentInspectorGinnaStation1503LakeRoadOntario,NY14519
