Dear Senator Schumer:

In a letter dated November 16, 2020, you requested information pertaining to the U.S. Nuclear Regulatory Commission (NRC) staffs review of the license transfer application for Indian Point Energy Center. Among other information, you requested a list of each instance where the NRC approved a license transfer application for a plant in decommissioning while hearing requests were pending.

I responded to your letter on November 20, 2020, stating that the NRC staff has issued two such approvals since 2007: Big Rock Point Facility & Big Rock Point Independent Spent Fuel Storage Installation (2007) and Pilgrim Nuclear Power Station (2020). I also stated that the NRC staff would continue to research whether it had issued such approvals prior to 2007.

The NRC staff has completed its review, and we have not identified any approvals prior to 2007 involving plants in decommissioning. After approving the transfer of the Indian Point licenses on November 23, 2020, the NRC staff subsequently approved a license transfer application for a plant in decommissioning while a hearing request was pending: Three Mile Island Nuclear Station, Unit No. 2 (December 2, 2020). For license transfer applications, the NRCs regulations state that the staff is expected to issue its licensing decision promptly after completing its safety evaluation report. For these license transfers where hearing requests were pending before the Commission at the time of the staffs decision, the order approving the application included a formal license condition stating that the transfer is subject to the outcome of any hearing.
