LICENSING OF BY PRODUCT MATERIALS PRODUCED AT THE UNIVERSITY MICHIGAN FORD NUCLEAR REACTOR IN SUPPORT OF THE HSSI PROGRAM
Dear Mr. Simpson:
This letter replies to your letter of June 10,1997 to Mr. Thomas Burdick of the Nuclear Regulatory Commission regarding the subject topic.

Your understanding as expressed in items 1. and 2. in the June 10 letter is correct. The reactor license extends to the Phoenix Memorial Laboratory as noted in your Technical Specifications Section 5.1 and in your Emergency Plan. However,in the review of the Indemnity Agreement (ccpy attached)it is noted that it only covers the following locations.
"The Ford Nucleac Aeactor Laboratory rt the north end of the Phoenix Memorial Laboratory Building and the ur. irradiated fuel element storage Room 2037A in the Phoenix Memorial Laboratory Building on the University's North Campus in Ann Arbor, Michigan."
If there are other locations, such as the Hot Cell, where nuclear materialis handled, it is suggested that you identify these areas and provide an explanation of how these areas are used so that they can be included in the indemnity agreement. Also, the eniergency plan thould be reviewed to determitie if any changes are needed, in recent conversations, you expressed an interest in revising License Condition 2.B.(4) to La more encompassing, such as being able to receive byproduct material under certain conditions, if you decida to proceed with this interest, please provide a rationale for a gn
