Dear Dr. Weiss:

At the Predecisional Enforcement Conference held at One White Flint North I

on April 22, 1998, the question was raised as to a 30 day written report, as per TS 6.6.2. (b.)(1.), due to you from our facility as a result of the

inspection of the FNR on February 23-27, 1998.

I I first became fully aware of the substantive variance that still existed in our TS when I read the Routine Safety inspection Report No. 50-002/98202 (DRPM), dated March 24, 1998, especially section 2.0 (1)

]

"10 CFR 50.59 Review" that begins on page 3. I gained further clarification in a phone conversation with our Inspector, Tom Burdick, on the morning of March 26, 1998. This was Tom's and my first opportunity to talk after the exit interview on February 27, 1998.

On April 2,1998, aware that we did indeed have a substantive TS variance, we submitted Amendment 44 to our License to the NRC. Ihad assumed that this satisfied our 30 day reporting requirement. If further reporting is necessary, please let me know and I will make the appropriate reports.
