NOTICE OF AVAILABILITY OF THE DRAFT ENVIRONMENTAL IMPACT STATEMENT FOR THE CONSTRUCTION PERMIT FOR THE PROPOSED SHINE MEDICAL RADIOISOTOPE PRODUCTION FACILITY
Dear Mr. Nelson:
The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review of a construction permit application submitted by SHINE Medical Technologies, Inc. (SHINE), for a radioisotope production facility. This facility, if licensed, would produce molybdenum-99 (Mo-99), iodine-131 (I-131), and xenon-133 (Xe-133) for use in diagnostic medical isotope procedures. The proposed location of this facility is approximately 4 miles south of the city center of Janesville, Wisconsin. As part of its review of the proposed action, the NRC has prepared a draft environmental impact statement (EIS) that includes analyses of relevant environmental issues, including potential impacts to historic, archeological and cultural properties from construction, operation, and decommissioning activities associated with the proposed facility.
As stated in our letter dated July 1, 2013, the NRC staff has determined that the area of potential effect (APE) for this undertaking is the area at the proposed site and its immediate environs that may be impacted by construction and post-construction land-disturbing operations.
The APE may extend beyond the immediate environs in those instances where construction and post-construction land-disturbing operations may potentially have an effect on known or proposed historic sites.
In the context of the National Environmental Policy Act of 1969, under which the draft EIS was prepared, the NRC staffs preliminary determination is that the impact of the proposed action on historical and archaeological resources is small, and additional mitigation is not warranted.
Under the provisions of the National Historic Preservation Act of 1966, the NRC staffs preliminary determination is that no historic properties will be affected by the proposed action.
In support of this conclusion, the NRC has conducted an environmental audit at the site and performed an independent analysis and review of historic and archaeological records. The NRC also initiated consultation with 19 Federally-recognized Native American tribes, notifying them of the proposed action and requesting comments and concerns. To date, one of the tribes, the Forest County Potawatomi, has responded. Documentation for tribal consultation is presented in Appendix D of the EIS.

Public meetings to discuss the findings of the draft EIS will be held on June 10, 2015, at the Rotary Botanical Gardens, 1455 Palmer Drive, Janesville, WI 53545. The first meeting will begin with an open house from 1:00 p.m. until 2:00 p.m., followed by an NRC presentation and opportunity to hear public comments from 2:00 p.m. until 4:00 p.m., as necessary. The second meeting will begin with an open house from 6:00 p.m. until 7:00 p.m., followed by a repeat of NRCs earlier presentation and opportunity to hear public comments from 7:00 p.m. until 9:00 p.m., as necessary. An NRC meeting notice will be published to provide more details about these public meetings. A separate Notice of Availability of the draft EIS will be placed in the Federal Register through the U.S. Environmental Protection Agency.
