received a request from the Nuclear Regulatory Commission (NRC) to comment on the Environmental Assessment for the Exemption Request for Arizona Public Service (APS)
Company's Palo Verde Nuclear Generating Station (PVNGS) Independent Spent Fuel Storage Installation in Wintersburg, Arizona. PVNGS has requested an exemption to load and store spent fuel with a larger maximum pellet diameter than authorized in Amendment No. 7 of the NAC International (NAC) CoC No. 1031 for the MAGNASTOR storage system.
PVNGS is requesting an exemption to load Combustion Engineering 16x16 spent fuel assemblies with a maximum pellet diameter of 0.3255 inch which is 0.0005 inch larger than the 0.325 inch maximum pellet diameter in Amendment No. 7 for CoC No. 1031. The BRC has reviewed the draft Environmental Assessment and draft Safety Evaluation Report provided by the NRC. In addition, the BRC has reviewed supporting documentation provided by NAC to support the requested change to the larger maximum pellet diameter of 0.3255 inch.
Based on the information reviewed by the BRC, the BRC concurs with the NRC's assessment that granting the PVNGS exemption request continues to provide adequate protection of public health and safety for the State of Arizona.

Mr. Goretzki, We recently received an exemption request from Arizona Public Service Company (APS), for their upcoming storage cask loading campaign that is scheduled to start on August 29th. APS requested an exemption from the requirements in Title 10 of the Code of Federal Regulations Part 72 to be able to deviate from Amendment No.
7 for Certificate of Compliance No. 1031 for the MAGNASTOR storage system.
The deviation requested by APS is to load a larger pellet diameter (0.3255 in) than approved in the MAGNASTOR certificate (0.3250 in). APS requested NRC approval of the exemption no later than August 19th in order to be able to maintain its schedule for the upcoming loading campaign. The loading campaign will ensure that APS maintains full-core offload capability during and after its refueling outage that is scheduled to begin October 5th.
I am working on the environmental assessment for the exemption. NRCs guidance in NUREG-1748, "Environmental Review Guidance for Licensing Action Associated
with NMSS Program," provides procedures on page D-3 for State Consultation on Draft Environmental Assessment. The guidance states that the staff PM should contact the State to inform them that the NRC has completed a draft EA and to negotiate a timeframe for review by the State that does not exceed 30 days.
I have not completed the environmental assessment yet (draft will be completed tomorrow pending internal reviews), but wanted to reach out to you early in the process to request your assistance in a timely review of the environmental assessment. Would you be the person that I should contact when I am about ready to send the environmental assessment for review?
