OF AUGUST 8, 2012, PUBLIC MEETING WITH THE TECHNICAL SPECIFICATIONS TASK FORCE RE: DRAFT REGULATORY ISSUE

SUMMARY

(RIS), NRC STAFF POSITION ON THE RELATIONSHIP BETWEEN GDC [GENERAL DESIGN CRITERIA]

REQUIREMENTS AND TECHNICAL SPECIFICATION OPERABILITY On August 8, 2012, the U.S. Nuclear Regulatory Commission (NRC) staff met with the Technical Specifications Task Force (TSTF) representatives to discuss and seek public comment on the Draft RIS, NRC Staff Position on the Relationship Between GDC Requirements and Technical Specification Operability (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML12137A346). The meeting was held at NRC offices in Two White Flint North, 11545 Rockville Pike, Rockville, Maryland 20852. A list of the meeting attendees is enclosed.

The meeting notice dated July 25, 2012, is available in the ADAMS under Accession No. ML12207A211.

The draft RIS clarifies the NRC staffs position on the relationship between the GDC for nuclear power plants and technical specification operability. In addition, the RIS clarifies the process for addressing non-conformances with GDC as incorporated into a plants current licensing basis.

After a short discussion on the NRC staffs position that the RIS does not establish any new positions, the industry agreed. There was no disagreement with the content of the RIS, but there will most likely be formal industry comments submitted in response to the Federal Register Notice (that provided the Draft RIS) requesting additional clarity on the current definition of operability and why it is being reemphasized in this RIS. The discussion also focused on issues contained in NRC Inspection Manual Chapter (IMC) Part 9900, "Technical Guidance, Operability Determinations and Resolution of Nonconformances of Structures, Systems, and Components."

The NRC staff indicated there will be a future workshop to discuss industry concerns with IMC Part 9900.
