LIMITED APPEARANCE STATEMENT OF DEPARTMENT OF ENERGY The Yakima Indian Nation (YIN) has submitted a Petition To Intervene and a Supplement to Petition To Intervene in the proceedings on the Amended Application For Construction Permits and Facility Licenses submitted by the Puget Sound Power and Light Company, et al. in the subject matter. In its Petition and Supplement the YIN contends that certain issues, including possible interference with or violation of reserved rights held by the YIN under the Treaty With The Yakimas which was executed on June 9, 1855 have not been addressed. The YIN also states that it ceded 10 million acres, including the Hanford Reservation, to the United States in that treaty.
In a Memorandum and Order Re: Supplement to Petition to Intervene of Confederated Tribes and Bands of Yakima Indian Nation, dated October 29, 1982, the Atomic Safety and Licensing Board at page 4 accepted as a contention the

p subsequent Memorandum and Order of November 2, 1982, the Board on page 2 4 rephrased the accepted sentence of the YIN's Contention 5 as follows:
Environmental impacts associated with the construction and operation of the S/HNP f acility at the proposed site on the Hanford Reservation must not infringe existing treaty rights of the Yakima Indian Nation. (YIN 5 - II. Note that Board has added certain words for purpose of specificity; no change of scope is intended.)
It is assumed that the Board's acceptance of the second sentence of the YIN's Contention 5 as described above does not equate with Board agreement that such treaty rights do in fact exist on the Hanford Site. There also appears to be a substantial question whether the Board has jurisdiction to resolve any disagreement that might exist or arise between the YIN and the United States regarding the existence or nonexistence of the YIN's described treaty rights on the Hanford Site.
Pursuant to Title 10, Code of Federal Regulations, Part 2.715, the Department of Energy hereby offers this limited appearance statement on the foregoing contentions of the YIN as they relate to the Hanford Reservation (hereinafter called the Hanford Site), more particularly those contentions based upon the portion of Article III of the Treaty of 1855 With The Yakimas (Attachment 1) which " secured" to the YIN, ". . . the privilege of hunting, gathering roots and berries, and pasturing their horses and cattle upon open unclaimed land."

HISTORY OF THE HANFORD SITE On February 8,1943, the War Department issued a Directive (Attachment 2) for acquisition of approximately 447,870 acres of land in the south central part of Washington State for the " Gable Project" (construction of f acilities to produce plutonium for nuclear weapons) to be conducted by the Manhattan District, Corps of Engineers. The Directive called for acquisition of fee title to about 100,000 acres on which the facilities were to be constructed, plus about 15,000 acres encompassing the City of Richland and the present 300 Area within the Hanford Site. The remainder of the 695-square mile area covered by the Directive was leased from private owners for the duration of the war. An Amended Directive (Attachment 3) was issued by the War Department on June 5,1944, to acquire approximately 430,780 acres, including 79,400 acres of public domain for the purpose of the facilities and protective perimeter.
The applicable public land orders (Attachment 4) withdrew and reserved the public dorkain for the use of the War Department for military purposes. Tight security was essential to protect that critical project. The February 8, 1943,

War Department Directive stated that access by other than authorized personnel was to be prohibited from the protective perimeter.
Pursuant to Executive Order 9816 (Attachment 5) effective midnight December 31, 1946, responsibility for the Hanford Site was transferred to the Atomic Energy i
Commission (AEC) which acquired fee title to lands in Benton, Grant, Franklin, and Adams Counties, that had been leased by the United States for use as part of the protective perimeter around the plant facilities. t of the Hanford Site was reserved for the AEC in connection with its Hanford Oper/dions. The AEC and the Bureau of Rec 1mnation also entered into an agreement (Attachment 7) under which the Bureau gave the AEC the " custody, possession, and use" of approximately 27,000 acres of acquired lands and certain public domain lands. The Hanford Site now includes approximately 570-square miles of acquired lands and public domain lands owned by the United States and located primarily in Benton County, Washington.
The prohibition against access to the Hanford Site by unauthorized personnel was continued by the AEC. The Hanford Site boundary where trespassing was prohibited pursuant to the Atomic Energy Act of 1954, as amended, Public Law 83-703, as implemented by Title 10, Code of Federal Regulations Part 160 was described in the Federal Register, Volume 30, No. 202 on October 19, 1965.
The nonregulatory authorities and functions of the AEC, including adminis-tration and operation of the Hanford Site and related f acilities, were transferred to the Administrator of the Energy Research and Development Administration (ERDA) by the Energy Reorganization Act of 1974, Public Law 93-438, and thereafter to the Secretary of Energy in 1977 (together with certain functions of other agencies and departments of the Federal government) by the Department of Energy Organization Act, Public Law 95-91. Currently l
most of the Hanford Site south of the Columbia River is fenced and/or posted to prohibit access by unauthorized personnel. This is pursuant to regulations set out in Title 10, Code of Federal Regulations, Part 860 and the authority of Section 229 of the Atomic Energy Act of 1954, as amended, which was among LIMITED APPEARANCE STATEMENT OF DEPARTMENT OF ENERGY - 4 i ,
the authorities transferred from the AEC to ERDA and thereafter to the Depart-ment of Energy as described above. The fencing and posting are primarily for security reasons and secondarily for protection of the health and safety of the public.
Attachment 8 is a map that'shows the location of the Hanford Site.
FACILITIES AND ACTIVITIES ON THE HANFORD SITE The Hanford Site is a broadly diversified production and laboratory complex devoted to Department of Energy programs of national and regional interest.
These include research and development and materials productian activities; breeder reactor development centered around the Fast Flux Test Facility, a 400-megawatt thermal, sodium-cooled reactor in which fuels, alloys, and other materials are tested; operation of the dual purpose N Reactor which produces plutonium and excess steam that is utilized to operate the nearby Washington Public Power Supply System electric generating plant; production of nuclear materials; management of defense radioactive waste's; environmental sciences to identify and determine the impact of man's activities upon the environment and biomedical and health effects research for evaluation of potential hazards from existing and developing energy technologies.
In addition, the Washington Public Power Supply System has almost completed construction of another nuclear power generating plant on the Hanford Site and has two partially completed plants located there. lines are on the Site as are other support services such as a bus system, security and patrol force, fire protection and medical personnel and facilities. The Bonneville Power Administration operates several substations within the Site boundary. A comaercially operated low-level radioactive waste disposal facility is located near the center of the Site. The Department of Energy and one of the applicants in the above-captioned matter, i.e., the Puget Sound Power and Light Company, have been negotiating for sale and purchase of a section of land on the Hanford Site and the granting of related easements for use in connection with construction and operation of one or more nuclear power generating plants.
THE HANFORD SITE IS NOT OPEN UNCLAIMED LAND As previously stated, the contentions of the YIN are based on the Article III of the 1855 treaty which reads as follows:
ARTICLE III. And provided, that, if necessary for the public convenience, roads may be run through the said reservation; and on the other hand, the right of way, with free access from the same to the nearest public highway, is secured to them; as also the right, in common with citizens of the United States, to travel upon all public highways.
The exclusive right of taking fish in all the streams, where 4
running through or bordering said reservation, is further secured to said confederated tribes and bands of Indians, as also the right of taking fish at all usual and accustomed places, in common with citizens of the Territory, and of erecting temporary buildings for curing them; together with the privilege of hunting; gathering roots and berries, and pasturing their horses and cattle upon open unclaimed land. (Emphasis added.)

l The YIN now contends the privilege extends to the Hanford Site as part of the 2
land ceded by the YIN to the United States in the treaty. The Hanford Site is not part of the YIN reservation that was established in the treaty.
The Departnent of Energy disagrees with the YIN's contentions. Judicial interpretation of Article III of the treaty is somewhat limited. Those cases cv...idering the language have generally involved state enforcement of hunting laws and regulations where treaty Indians were hunting outside the boundarics of their reservation.
The privilege secured by the treaty has been recognized as one which is limited in scope. It does not extend to all lands which the YIN ceded to the United States but only to open unclaimed land. The courts have recognized that the parties to the treaty knew that land which was then open would be occupied and put to other uses and the privilege would no longer apply. For instance, in State v. Coffee, 556 P.2d 1185 (Idaho, 1976), an Indian was convicted of violating state hunting regulations by shooting and killing a deer on private

property and out of season. The Indian was a member of a nontreaty, non- '
reservation tribe and contended she had an aboriginal right, as distinguished from a treaty right, to hunt on the private proper'y. The Court agreed with earlier conclusions of the Indian Claims Commission that although her tribe had not been a signatory to the Hellgate Treaty of 1855, that treaty extin-guished her tribes' aboriginal rights in the affected land and she had only a continuing right to hunt on open and unclaimed land. The pertinent language in the Hellgate Treaty of 1855 is almost identic?1 to the Article III language in the treaty with the YIN with respect to the privilege of hunting, gathering LIMITED APPEARANCE STATEMENT OF DEPARTMENT OF ENERGY - 7
roots and berries and pasturing their horses and cattle upon open unclaimed land. The only difference is that the Hellgate Treaty used the words "open and unclaimed land" whereas the words "open unclaimed land" were used in the treaty with the YIN. The court found that such language gave no privilege to hunt on privately-owned land since that land is not open and unclaimed. The fact that the land may have been open and unclaimed at the time the treaty was signed was not dispositive. It is apparent from the court's decision that the status of the land as open and unclaimed is determined by its present status, not by its status at the time of the treaty. To hold otherwise would have made all land ceded by the Indians inalienable, a result that was clearly not the intent of the signatories to the treaties. Land which no longer remains both open and unclaimed is not subject to the privilege described in the treaties.
A review of the treaty minutes prepared at the time of negotiating the 1855 Treaty with the YIN as quoted in State v. Chambers, 81 Wash. 2d 929, 936, 506, P.2d 311, 315 (1973) confirms that the privilege of hunting, gathering roots and berries and pasturing their horses and cattle was limited in scope. For example, the Article III privilege is explained in part in the minutes at folio 123:
They shall have the same liberties outside the Reservation to pasture animals on land not occupied by whites, to kill game, to get berries and to go on the roads to market.
(Emphasis added.)

It is apparent that the treaty signatories intended the terms "open and unclaimed" to mean those ceded lands not occupied and put to use by " whites."

When considered from that vantage it is clear that the Hanford Site is neither "open" nor " unclaimed." The site was established in 1943 to carry out an essential defense function of the Federal government - the production of plutonium for nuclear weapons. The activities at the site have since been l greatly expanded by the research, development and production programs, reactor operations, management of radioactive wastes, environmental. sciences and other functions undertaken by the Department of Energy and its predecessors as described earlier in this statement.
The Hanford Site is not "open" land. Shortly after selection of the site in 1943, the operational areas (including the area upon which the Puget Powei-plants are proposed) were fenced and closed to all persons except those authorized to enter. The site has essentially remained closed to the public ever since. This is in marked contrast to the Federal government's ownership of other lands such as national forests which areJheld for a nonproprietary purpose and are open to the public at large. Cases which have denied enforce-ment of state hunting regulations against Indians hunting on national forest lands on the basis of the treaty privilege to hunt on open unclaimed land are simply not applicable to the Hanford Site.1 Acceptance of the YIN's 1

assertion of the Article III treaty privilege of hunting, pasturing their horses and cattle, etc. on the Hanford Site would require a finding that similar privileges exist on such Federal installations as large air bases, forts and camps - a conclusion that was clearly not intended by the treaty.
4 The Hanford Site is not " unclaimed" land. In establishing'the Hanford Site for the operations conducted thereon the Federal government obtained the i privately-owned portion by negotiation or condemnation and reserved the 4
public domain portion for military purposes and later for the AEC's Hanford Operations. These actions clearly constitute a claim as to the land.
l Thus, neither of the conditions precedent to the asserted privilege on the Hanford Site can be met. The site is not "open" since it has been fenced and closed to the public since 1943. It is not " unclaimed" as it has been reserved, occupied and utilized by the Government for an essential national purpose.
Although the analysis set forth above shows that ti2 claim asserted by the YIN does not apply to the Hanford Site, it should be noted that to the best of our knowledge the assertion of the described privilege is made for the first time l in this licensing proceeding. The claim has never been made to the Department l of Energy or its predecessor agencies in the almost 40 years of operation of the site.

There is a military necessity for the acquisition of land indicated under subject abovo, and described more in detail in paragraph 2 below.
- 2. Description f land and other pertinent data are as follows:
- a. DRIEF DESCRIPTION OF IRID: The area involved lies in the south ccatral part of the Stato of Washington within parts of Benton, Yakima, Grant, Adams and Franklin Counties, as shown on the inclosed map.
, b. PROPOSED USE: The land is required in connection with the activitios of the lianhattan District, Corps of Engineers.
- c. ACREAGE INVOLVED: Approximately 447,870 acres of land.
- d. It1PROVEMSUTS : The acquisition involvos the purchase or lease of complete power plants, telephone systems, water supply sys-tems, railroad and water power facilitios, as well as nu=orous homes and business structures.

ESTI!aTED COST: Approxis:ately $3,281,300 for tho fee in m ., arca designated "A" (conter red); approximately $1,522,400 for the fee in area designated "D" (red); approximately $65,000 per ansun for a lensohold intorest in area "B" (bluo); approximately $60,000 for the acquisition of all improvements on area "B"; approximately $50,000 for a lonoohold interest in area designated "C" (groon); and an addi- .
tional $100,000 for land acquisition in fee simplo within Areas "B" and "C", and improvements in Aron "C",
if necessary. Area "E" will required approximately $75,000 for a leasehold interest in (Brown) both land and improvomonts.
- f. !ETHOD OF ACC,UISITION: Areas "A" and "D" will be acquired in foo simplo, and Areas "B" and "C" will be acquired by leasehold arrangemont excopt for.the developed farn land and imprevements which will be acquired in fee simplo by negotiation or condemnation.

REISRKS: In regard to the portion designated "B" the areas theroin which are irrigated and devoloped and for(blue area) which completely restrictivo leases are impracticablo are to be pur-chased. The remaining areas are to be leased. Othor than for the main-tenance and development of access routes to the enclosed red areas, the leased blue nron will not be utilised but access by other than authorized personnel is to be prohibited. The branch lins railroad need not be acquired outside of the blue and rod areas. Furthermore, it is undorstood that acquisition of any realty interest therein is subject to clearance by the Interdepartmental Air Traffic Control Board and the release by the United States Navy of any of the land within.:the project now being considered for training area.
- 3. Tho determination of military necessity is based upon the recommen-dation of the Deputy Chief, Construction Division, Corps of' Engineers, as indicated in the inclosed memorandum, dated February 5,1943.

By vitrue of the authority vested in the President and pursuant to Executive Order No. 10355 of May 26, 1952 (17 F.R. 4831), it is ordered as follows:
- 1. All public lands, except those described in paragraph 4 hereof, reserved for the use of the War Department for military purposes by Public Land Orders No.165 of September 6,1943, No.191 of November 1,1943, and No. 261 of January 24, 1945, are hereby reserved for and transferred to the jurisdiction of the Atomic Energy Commission, for use in connection with the atomic energy -
program.
- 2. The withdrawals rnde by the said public land orders, as modified by this order, shall be subject to existir.g withdrawals for power-site and Federal power project purposes, so far as they affect any i of the lands involved; and they shall take precedence over, but t not otherwise affect, the existirg withdrawals for reclamation l '
.. purposes, so far as they affect any of such lands.

- 3. The said public land orders are hereby amended so as to delete .
therefrom the following paragraph: ,
The jurisdiction granted by this order shall cease at the
.' expiration of the six months' period following the termination '
of the unlimited national emergency declared by Proclamation No. 2427 of May 27,1941 (55 Stat.1647) . Thereupon, jurisdiction over the lands hereby reserved shall be vested in the Department of the Interior, and any other department or agency of the Federal Government according to their recpective interests then of record.
The lands, however, shall remain withdrawn from appropriation as
! herein provided until otherwise ordered.

i 4. The said Public Land Order No. 261 of January 24, 1945, is hereby 4
revoked so far as it affects the following-described lands, which
- are included in existing withdrawals for reclamation purposes

- 2. Transfer of all rights to custody, possession, and usa from the "w:
Buraan to the Commission of the acquired lands described in Exhibit "B",
attached hareto and mde a part hereof, and the Trithdrmm lands described in Exhibit "C", attached hereto and mada a part hareof, all of which ara located within the Control Zone, is hereby acccmplished. Such transfer is subject to the following:
(a) The right of the Bureau to construct, oparate, and maintain the Wahluka Canal and related facilities and structuras at about elevation 965 (USBR Datum) and any necessary wastoways and drain-age ways through the Control Zona in connection with the irrigation of lands on the Wahluka Slope but outside of the Control Zono.
- 3. The transfer of rights under Articlo 2 hereof shall remain opera-

tivo so long as the lands involved remain.in Control Zone status, as determined by the Comission. If it is determined by the Commission that custody, possession, and use of such lands is no longar required, relin-quishment of all such rights transferred hereby will be accomplished by notice in writing from tha lhnager, Hanford Operations Office, Atomic Energy Commission, to the Regional Director, Region 1, Bureau of Reclamation.
- h. The greator portion of the lands included within the Control Zone were included in the South Columbia Basin Irrigation District and the East Columbia Basin Irrigation District at the time of their formation.

( s A monetary adjustment will be nocessary as to the Control Zone lands which are permanently removed from, or are rendered infeasible of, irrigation development as a part of th'a Columbia Basin Project, but such adjustment shall be deferred until the Socrotary of the Interior concludes that such is required. Such adjustment would cover out-of-pockat costs such as purchase prico, costs incurred in their acquisition and administration, and various preliminary engineering and 'investigativo costs applicable to the lands described in said exhibit "B". Further amounts may be sought by the Bureau, af ter consultation with the Commission, to be included in such adjustment, with the approval of the Congress, by reason of other costs or losses incurred or to bo incurred by the Columbia Basin Project as a result of diminution in the total project irrigable area through the permanent removal from irrigation development as a part of the Columbia Basin Project of any or all of the irrigable lands located within the ex-terior boundaries of the Control Zone, irrespective of ownership.
- 5. The Bureau has a continued interest in the ultimate development of tho irrigable lands of the entire Wahluka Slope as a part of the Columbia Basin Project. The Commission is fully cuare of that interest and hereby reaffirms its policy of keeping to a minimum its land ownership and restric-
. tions on land use on the 11ahluko Slope.
