Dear Mr. Andersen,

It's my understanding that a purpose of the San Onofre Oversight Panel which you co-chair is to ensure that NRC actions addressing the root cause and corrective actions with respect to unexpected steam generator tube degradation are clearly communicated and documented.

Has the NRC required the licensee to provide a comprehensive root cause analysis of all tube degradation in Unit 2?

Is the NRC confident that the root cause of the unprecedented and extensive tube degradation in Unit 2 is fully understood?

Has the NRC limited the scope of the root cause analysis to only what is considered to be "unexpected ...tube degradation"?

Please define for me which tube degradation is not the subject of root cause analysis by virtue of faIling outside your definition of "unexpected".

The revised panel charter establishes the purpose, objectives, and composition of the San Onofre Nuclear Generating Station (SONGS) Oversight Panel. The panel was established to ensure that the agency's actions to address the root cause and cOlTective actions, with respect to the unexpected steam generator tube degradation at SONGS, are clearly communicated and documented, and to provide a recommendation for either approval or denial of restart. The panel charter was revised to reflect changes in panel membership and minor editorial improvements. SAN ONOFRE NUCLEAR GENERATING STATION OVERSIGHT PANEL CHARTER (REVISION 1)

Purpose

1. Ensure the NRC communicates a unified and consistent position in a clear and predictable manner to the licensee, public, and other stakeholders.

2. Establish a record of the major regulatory and licensee actions taken and technical issues reviewed, including adequacy of licensee corrective actions.

3. Provide a recommendation regarding restart of SONGS Unit 2.

Objectives The Panel's duties and planned accomplishments include the following:

1. Develop and implement the Panel Process Plan.

2. Maintain the comprehensive Communication Plan to ensure effective communication with internal and external stakeholders. Provide oversight and direction to the Communications Team.

3. Maintain cognizance over the status of the Confirmatory Action Letter (CAL) items and recommend to the Regional Administrator, in consultation with cognizant program office management, any necessary modifications. Recommend development of other regulatory actions as appropriate.

4. Assess the physical readiness of the plant for restart.

5. Periodically provide NRC management and the Commission, if requested, briefings and updates on the status of the licensee's progress in resolving the agency's questions with respect to the CAL response for Unit 2.

6. Conduct periodic public meetings with the licensee to discuss: (1) status of NRC's assessment of the licensee's response to the CAL for Unit 2; and (2) basis for recommendation regarding restart of Unit 2. Upon completion of inspection and technical review (including assessment of licensee's CAL response and completion of Technical Evaluation Report), provide a written recommendation and the basis for the restart recommendation for Unit 2 to the Regional Administrator and the Director of the Office of Nuclear Reactor Regulation (NRR).

7. Make recommendations regarding conduct of an independent root cause and agency lessons learned review.

The Chief, SONGS Project Branch, Region IV is responsible for documenting and distributing the Panel meeting minutes.
