31.0INTRODUCTION
By application dated March 28, 2006 (Agencywide Documents Access and ManagementSystem Accession No. ML061020060), Union Electric Company (the licensee) requested changes to the Technical Specifications (TSs) in Facility Operating License No. NPF-30 for theCallaway Plant, Unit 1 (Callaway). The licensee is proposing to revise a position title and department name in TS 5.0, "Administrative Controls."
2.0REGULATORY EVALUATION
In Section 50.36 of Title 10 to the Code of Federal Regulations (10 CFR 50.36), the NuclearRegulatory Commission (NRC) issued a rule and established its regulatory requirementsrelated to the content of TSs. In doing so, the NRC emphasized those matters related to theprevention of accidents and mitigation of consequences of such accidents. As recorded in the Statements of Consideration, Technical Specifications for Facility Licenses: Safety Analysis Reports (33 FR 18610, December 17, 1968), the NRC noted that licensees are expected toincorporate into their plant TSs those items that are directly related to maintaining the integrityof the physical barriers designed to contain radioactivity. Pursuant to 10 CFR 50.36, TSs are required to include items in five specific categories related to station operation. Specifically, those categories include: (1) safety limits, limiting safety system settings, and limiting controlsettings; (2) limiting conditions for operation; (3) surveillance requirements; (4) design features;and (5) administrative controls. However, the rule does not specify the particular requirements to be included in a plant's TSs.In 10 CFR 50.36(c)(5), "Administrative controls," it is stated that "Administrative controls are theprovisions relating to organization and management, procedures, recordkeeping, review and audit, and reporting necessary to assure operation of the facility in a safe manner." Therefore,the position title and department name in TS 5.0 must reflect the organization operating the facility.
3.0TECHNICAL EVALUATION
In its application, the licensee identified the following changes to TS 5.0:1.In TS 5.1.2, replace (1) the title "Shift Supervisor (SS)" by "Shift Manager (SM)" and(2) the abbreviations "SS" by "SM." 2.In TSs 5.2.2.c, 5.2.2.d, and 5.7.2.a.1, replace the department name "health physics" inthe phrase "health physics technician" or "Health Physics Supervision," by the name "Radiation Protection Department," and3.In TSs 5.2.2.f, 5.3.1.1, and 5.7.2.a.1, replace the title "Shift Supervisor" by the title "ShiftManager."For the change from "shift supervisor" to "shift manager," the licensee stated that the proposedamendment will change the position title to shift manager to more accurately reflect themanagement's functions and responsibilities being performed by these individuals. The titlechange is stated to be administrative in nature and does not result in a change to the reporting relationships, job responsibilities, job functions, organizational commitments, or the qualificationrequirements of plant personnel. This includes the proposed change in abbreviation to SM, which stands for shift manager. Based on this, the NRC staff concludes that the proposedchange to Shift Manager is not changing any requirements in the TSs and reflects the organization operating the facility. Therefore, the proposed changes to TSs 5.1.2, 5.2.2.f, 5.3.1.1, and 5.7.2.a.1 meet 10 CFR 50.36 and are, therefore, acceptable.For the change from "health physics" to "Radiation Protection Department," the licensee statedthat the change in the name of the department aligns the Callaway organization with thenuclear industry and better reflects the functions performed by this Callaway organizational unit.
The change in title of the department is stated to be administrative in nature and does not represent any change in reporting relationships, job responsibilities, overall organizationalstructure, or organizational commitments. Based on this, the NRC staff concludes that theproposed change to Radiation Protection Department is not changing any requirements in the TSs and reflects the organization operating the facility. Therefore, the proposed changes toTSs 5.2.2.c, 5.2.2.d, and 5.7.2.a.1 meet 10 CFR 50.36 and are, therefore, acceptable.Based on the above evaluation, the NRC staff concludes that the proposed amendment isacceptable.
4.0STATE CONSULTATION
In accordance with the Commission's regulations, the Missouri State official was notified of theproposed issuance of the amendment. The State official had no comments.
5.0ENVIRONMENTAL CONSIDERATION
The amendment changes a requirement with respect to the installation or use of a facilitycomponent located within the restricted area as defined in 10 CFR Part 20. The NRC staff hasdetermined that the amendment involves no significant increase in the amounts, and nosignificant change in the types, of any effluents that may be released offsite, and that there isno significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration and there has been no public comment on such finding (71 FR 27005; published May 9, 2006). Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9). Pursuant to 10 CFR 51.22(b)no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.
6.0CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) thereis reasonable assurance that the health and safety of the public will not be endangered byoperation in the proposed manner, (2) such activities will be conducted in compliance with theCommission's regulations, and (3) the issuance of the amendment will not be inimical to thecommon defense and security or to the health and safety of the public.Principal Contributor: Jack Donohew Date: July 11, 2006 Callaway Plant, Unit 1 cc:Professional Nuclear Consulting, Inc.
