IMPOSITION OF CIVIL PENALTY - $25,000 By EN 85-68 dated September 26, 1985, the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars to Commonwealth Edison Company. This action was based on three separate events which involved the failure of management to follow radiation protection procedures, evaluate radiological conditions and to prepare adequate procedures.

The licensee responded to the Notice in a letter dated November 21, 1985. After careful consideration of the licensee's response, the staff has concluded that a sufficient basis exists for mitigating the proposed $50,000 civil penalty by 50 percent because of the licensee's extensive corrective actions. Accordingly, an Order Imposing Civil Penalty in the amount of Twenty-five Thousand Dollars has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
