. OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Ucensee: Commonwealth Edison Company (EA 97-264)

Byron Station Docket Nos. 50-454 and 50-455 Sublect: PROPOSED IMPOSITION OF civil PENALTY - $55,000 This is to inform the Commission that a Notice of Viciation and Proposed imposition of Civil Penalty in the amount of $55,000 will be issued on or about October 3,1997 to the Commonwealth Edison Company. This action is based on a Severity Level lli problem involving two violations of falling to comply with technical specifications. The first violation consists of two examples of falling to vent emergency core cooling system pump casings and discharge piping high points. at least once every 31 days. The second violation consists of two examples of falling to perform a continuity check on Containment Isolation '

Phase "A" Isolation Valves on a quarterly basis.

Because this was not the first escalated enforcement action within the past 2 years, the staff considered whether credit was warranted for identification and corrective action. Credit was not warranted for identification because the violations were identified by the NRC. Credit was warranted for corrective action because the corrective actions were considered prompt cnd comprehensive, it should be noted that the licensee has not been specifically informed of the enforcement acjon. Mailing of Notice October 3,1997 Telephone Notification of Licensee October 3,1997 The State of Illinois will be notified. 4 The licensee has thirty days from the a ste of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
