IMPOSITION OF CIVIL PENALTY - $25,000 By EN 86-84 dated November 13, 1986 the Comission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand ($25,000) to Comonwealth Edison Company.

This action was based on a violation involving the installation of a Pressurizer Code Safety Valve without its valve disc. The defective safety valve was installed because of improper segregation, identification, and test documentation. In addition, the replacement Code Safety Valve was tested and accepted with a lift setting outside the technical specification limits because of procedural deficiencies.

The licensee responded to the Notice in a letter dated December 30, 1986. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty. Accordingly, an Order Imposing Civil Penalty in the amount of $25,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
