EN 85-45A OFFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Comonwealth Edison Company Byron Nuclear Power Station Docket No. 50-454
Subject:
IMPOSITION OF CIVIL PENALTY - $25,000 By EN-45 dated June 3,1985 the Comission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $25,000 to Comonwealth Edison Company. This action was based on a violation involving a failure to adequately implement compensatory measures to control access into a vital area of the Bryon Nuclear Power Station at Byron, Illinois. The base civil penalty of $50,000 was nitigated 50% because of extensive and comprehensive corrective action.
The licensee responded to the Notice in a letter dated July 18, 1985. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Irposition of Civil Penalty and that further mitigation of the proposed civil penalty is not warranted. Accordingly, an Order Imposing Civil Penalty in the amount of Twenty-five Thousand Dollars has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
