As part of its review of the proposed action, the NRC has prepared a draft environmental impact statement (EIS). This letter is to inform you and members of your tribe that the draft EIS is available for public comment. The draft EIS includes analyses of relevant environmental issues, including potential impacts to historic, archeological and cultural properties from construction , operation, and decommissioning activities associated with the proposed facility. As stated in our letter to your tribe dated July 1, 2013 , the NRC is conducting Section 106 consultations in compliance with the National Historic Preservation Act (NHPA) through the requirements of the National Environmental Policy Act (NEPA), as outlined in 36 CFR 800.8(c). In the context of NEPA, the NRC staff's preliminary determination is that any impact from the proposed action on historical and archaeological resources located in the area of potential effect would be small. Under the provisions of the NHPA, the NRC staff's preliminary determination is that no historic properties would be affected by this undertaking

Dear Chairman Barrett

The U.S. Nuclear Regulatory Commission (NRC) is conducting an environmental review of a construction permit application submitted by SHINE Medical Technologies, Inc. (SHINE)

, for a radioisotope production facility.

This facility, if licensed, would produce molybdenum

-99 (Mo-99), iodine

-131 (I-131), and xenon

-133 (Xe-133) for use in diagnostic medical isotope procedures.

The proposed location of this facility is approximately 4 miles south of the city center of Janesville, Wisconsin.

Under the provisions of the NHPA, the NRC staff's preliminary determination is that no historic properties would be affected by this undertaking

. The justification for these conclusions is explained in the draft EIS

. As discussed in the draft EIS, these conclusions are based upon 1) the environmental report submitted by SHINE; 2) NRC's environmental audit of the proposed site and independent analysis and review of historic and archaeological records; 3) consultation with Federal, State, Tribal and local agencies; and 4) consideration of public comments received during the scoping process.

J. Barrett Please find a copy of the draft EIS with these conclusions enclosed. Pursuant to 36 CFR 800.8(c), we are requesting your comments on the draft EIS and on our preliminary conclusions.

Electronic comments on the draft EIS may be submitted to the NRC by accessing www.regulations.gov and searching for Docket ID NRC-2013-0053. Written comments may be mailed to the NRC at:

Office of Administration, Mail Stop: OWFN-12-H08 U.S. Nuclear Regulatory Commission Washington, DC 20555

-0001 Please note that the public comment period for the draft EIS ends on July 6, 2015

. The NRC staff will hold public meetings prior to the close of the public comment period to present an overview of the draft EIS and to accept public comment on the document.

Public meetings to discuss the findings of the draft EIS will be held on June 10, 2015, at the Rotary Botanical Gardens, 1455 Palmer Drive, Janesville, WI 53545. The first meeting will begin with an open house from 1:00 p.m. until 2:00 p.m., followed by an NRC presentation and opportunity to hear public comments from 2:00 p.m. until 4:00 p.m., as necessary. The second meeting will begin with an open house from 6:00 p.m. until 7:00 p.m., followed by a repeat of NRC's earlier presentation and opportunity to hear public comments from 7:00 p.m. until 9:00 p.m., as necessary.

An NRC meeting notice will be published to provide more details about these public meetings. A separate Notice of Availability of the draft EIS will be placed in the Federal Register through the U.S. Environmental Protection Agency.

NOTICE OF AVAILABILITY OF THE DRAFT ENVIRONMENTAL IMPACT STATEMENT FOR THE CONSTRUCTION PERMIT FOR THE PROPOSED SHINE MEDICAL RADIOISOTOPE PRODUCTION FACILITY

Dear Tribal Chairperson Pearson:

As part of its review of the proposed action, the NRC has prepared a draft environmental impact statement (EIS). This letter is to inform you and members of your tribe that the draft EIS is available for public comment. The draft EIS includes analyses of relevant environmental issues, including potential impacts to historic, archeological and cultural properties from construction, operation, and decommissioning activities associated with the proposed facility. Under the provisions of the NHPA, the NRC staff's preliminary determination is that no historic properties would be affected by this undertaking

. The justification for these conclusions is explained in the draft EIS.

M. Pearson Please find a copy of the draft EIS with these conclusions enclosed.
