This report provided the decommissioning funding status for the FENOC plants for the year ending December 31,2012. The Nuclear Regulatory Commission staff has been reviewing the submittal and has determined that additional information is needed to complete its review. The specific questions are found in the enclosed request for additional information (RAI). The questions were sent via electronic transmission on July 2,2013, to Mr. Phil Lashley, of your staff. The draft questions were sent to ensure that the questions were understandable, the regulatory basis was clear, and to determine if the information was previously docketed. The questions were discussed in a teleconference with your staff on July 11, 2013. In that teleconference, it was agreed that draft RAI #2 for BVPS and draft RAI #2 for Perry would be deleted. This letter incorporates the RAI changes discussed in the teleconference on July 11, 2013, and thus supersedes the draft questions previously sent to Mr. Lashley by electronic correspondence. Further, in the teleconference, it was agreed that a response to this RAI would be submitted within 45 days of the date of this letter.

S0-440 By letter dated March 2S, 2013 (Agencywide Documents Access and Management System Accession Number ML 13084A374), FirstEnergy Nuclear Operating Company (FENOC, the licensee) submitted the 2013 Decommissioning Funding Status report for Perry Nuclear Power Plant (PNPP), Unit No.1, as required under Section SO.7S(f)(1) to Title 10 of the Code of Federal Regulations (10 CFR). The U.S. Nuclear Regulatory Commission (NRC) staff is currently reviewing the submittal and has determined that the additional information requested below is needed to complete its review. Per 10 CFR SO.7S(f)(1), licensees must identify "the amount accumulated to the end of the calendar year preceding the date of the report." This actual amount is dedicated for activities that relate to the definition of "decommission," as specified in 10 CFR SO.2, "Definitions." By letter dated March 2S, 2013, FENOC provided the amount accumulated in the decommissioning trust fund at the end of the calendar year preceding the date of the report for items included in 10 CFR SO.7S(b) and (c). The NRC staff requests that FENOC indicate what portion of the accumulated fund balances are for radiological decommissioning activities only.
