CATAWBA NUCLEAR STATION, UNITS 1 AND 2 AND MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 - WITHDRAWAL OF AMENDMENT REQUESTS (TAC NOS. ME4256, ME4257, ME4258, AND ME4259)

Dear Messrs Morris and Repko:

By letter dated June 29, 2010, you applied for amendments to the Catawba Nuclear Station, Units 1 and 2, Renewed Facility Operating License Nos. NPF-35 and NPF-52, and for amendments to the McGuire Nuclear Station, Units 1 and 2, Renewed Facility Operating License Nos. NPF-9 and NPF-17. The proposed change would have modified the facility Technical Specification (TS) 3.3.1, "Reactor Trip System (RTS) Instrumentation" and TS 3.3.2, "Engineered Safety Feature Actuation System (ESFAS) Instrumentation." Subsequently, by letter dated April 12, 2011, you withdrew the amendment request.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

AND 50-414 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENTS TO RENEWED FACILITY OPERATING LICENSES The U.S. Nuclear Regulatory Commission (the Commission, NRC) has granted the request of Duke Energy Carolinas, LLC (the licensee) to withdraw its June 29,2010, application for proposed amendments to Renewed Facility Operating License Nos. NPF-9 and NPF-17 for the McGuire Nuclear Station, Units 1 and 2, located in Mecklenburg County, North Carolina, and for proposed amendments to Renewed Facility Operating License Nos. NPF-35 and NPF-52 for the Catawba Nuclear Station, Units 1 and 2, located in York County, South Carolina.

The proposed amendment would have revised Technical Specification (TS) 3.3.1, "Reactor Trip System (RTS) Instrumentation" and TS 3.3.2, "Engineered Safety Feature Actuation System (ESFAS) Instrumentation."

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on January 25. 2011 (76 FR 4384).

However, by letter dated April 12, 2011, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated June 29,2010, and the licensee's letter dated April 12, 2011, which withdrew the application for license amendment.
