Mr. Cochran, Good Morning! When the NRC publishes an initial notice that we are reviewing a request and that weve made a no significant hazards consideration determination, its usually 30 days following the notice in the Federal Register, but the staff will normally respond to comments within the hearing period (usually 60 days).
Comments from the State, however, are handled a bit differently than the public. Im guessing that Mr. Lingam sent you the below email for your comments since the NRC expects to issue the Diablo Canyon NFPA-805 amendments in the next few weeks. We dont have a set comment period for the State, our regulations say within a timely manner of the State notification of impending issuance of the licensing action.
You are certainly within an appropriate time frame for this amendment. Since Mr. Lingam is on leave, I am happy to take your comments. Weve received some weather here in DC today and Im working at home. If youd like to discuss by phone, I can be reached through the NRC Operator at 301-415-7000, ask for Lisa Regner at home.

ML13277A457, ML14272A470, ML14300A706, ML14302A804, ML14332A120, 1
ML14365A377, ML15056A774, ML15056A776, ML15127A649, ML15300A005, ML15365A534, and ML16028A494, respectively), for Diablo Canyon Power Plant (DCPP), Units 1 and 2 requesting NRC approval.
The amendment requests approval to transition the DCPP fire protection program to a risk-informed, performance-based program based on National Fire Protection Association (NFPA) 805, Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants, 2001 Edition (NFPA 805), in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Paragraph 50.48(c). NFPA 805 allows the use of performance-based methods such as fire modeling and risk-informed methods such as fire probabilistic risk assessment to demonstrate compliance with the nuclear safety performance criteria.
No significant hazards consideration was published in the Federal Register on December 26, 2013 (78 FR 78408) for the above described license amendment. Please provide your comments, if any, on the issuance of the above described license amendment.

When the NRC publishes an initial notice that we are reviewing a request and that weve made a no significant hazards consideration determination, its usually 30 days following the notice in the Federal Register, but the staff will normally respond to comments within the hearing period (usually 60 days).

Comments from the State, however, are handled a bit differently than the public. Im guessing that Mr. Lingam sent you the below email for your comments since the NRC expects to issue the Diablo Canyon NFPA-805 amendments in the next few weeks. We dont have a set comment period for the State, our regulations say within a timely manner of the State notification of impending issuance of the licensing action.

You are certainly within an appropriate time frame for this amendment. Since Mr. Lingam is on leave, I am happy to take your comments.
