On March 12, 2012, the Nuclear Regulatory Commission (NRC) staff issued a letter entitled, Request for Information Pursuant to Title 10 of the Code of Federal Regulations 50.54(0 Regarding Recommendations 2.1, 2.3, and 9.3, of the Near-Term Task Force Review of Insights from the Fukushima Dai-Ichi Accident (Reference 1). Enclosure 5 of the Request for Information (RFI) letter (Reference

: 2) contains specific Requested Actions and Requested Information associated with the Near-Term Task Force (NTTF)Recommendation 9.3 for Emergency Preparedness (EP) programs.
On March 12, 2012, the Nuclear Regulatory Commission (NRC) staff issued a letter entitled, Request for Information Pursuantto Title 10 of the Code of FederalRegulations 50.54(0 Regarding Recommendations 2.1, 2.3, and 9.3, of the Near-Term Task Force Review of Insights from the Fukushima Dai-IchiAccident (Reference 1). Enclosure 5 of the Request for Information (RFI) letter (Reference 2) contains specific Requested Actions and Requested Information associated with the Near-Term Task Force (NTTF)
In accordance with 10 CFR 50.54, "Conditions of licenses," paragraph (f), addressees were requested to submit a written response to the information requests within 90 days.6D AOO/f U.S. Nuclear Regulatory Commission Page 2 The RFI states that if an addressee cannot meet the requested response date, then the addressee must provide a response within 60 days of the date of the letter and describe the alternative course of action that it proposes to take, including the basis of the acceptability of the proposed alternative course of action and estimated completion date.The purpose of this letter is to provide TVA's response for its nuclear units with construction permits in deferred status, Bellefonte (BLN) Units 1 and 2.Proposed Alternative Course of Action In its approval to complete BLN Unit 1, the TVA Board of Directors' decision stipulates that resumption of construction activities will occur only after the initial loading of fuel at Watts Bar Unit 2. As previously committed in TVA's letter dated September 1, 2011 (Reference 3), TVA will submit a construction reactivation letter to the NRC for BLN Unit 1 in accordance with the provisions of NRC Generic Letter (GL) 87-15. The reactivation letter will support the resumption of construction after the initial loading of fuel at Watts Bar Unit 2 has been accomplished.
Recommendation 9.3 for Emergency Preparedness (EP) programs. In accordance with 10 CFR 50.54, "Conditions of licenses," paragraph (f), addressees were requested to submit a written response to the information requests within 90 days.
After considering the deferred construction status of BLN Units 1 and 2 and a careful review of the requested actions, we find that we will be unable to meet the response dates requested in the RFI for NTTF Recommendation 9.3. As part of the construction reactivation letter for BLN Unit 1, TVA will provide a schedule for addressing the specific Requested Actions and Requested Information identified in the RFI for NTTF Recommendation 9.3. Based on the current schedule, TVA anticipates submittal of a construction reactivtation letter for BLN Unit 1 in FY2014.Basis for Proposed Alternative Course of Action Bellefonte Units 1 and 2 are currently in a deferred construction status as defined in GL 87-15. Given the deferred construction status of the plant, BLN is not required to have an EP program and therefore cannot meet the Requested Actions and Requested Information identified in the RFI for NTTF Recommendation 9.3.TVA is preparing an update to the existing Operating License (OL) application for BLN Units 1 and 2, which will include an Emergency Plan as required by 10 CFR 50.34(b).All Requested Actions and Requested Information detailed in the RFI for NTTF Recommendation 9.3, as well as other rulemaking and regulatory changes that have occurred since the existing OL application was submitted will be considered during development of the BLN Emergency Plan. Therefore, submitting a schedule for addressing the specific Requested Actions and Requested Information identified in the RFI for NTTF Recommendation 9.3 as part of the construction reactivation letter for BLN Unit 1 is an acceptable alternative course of action.
