WITHDRAWAL OF NUCLEAR DEVELOPMENT, LLC. APPLICATION FOR ORDER APPROVING CONSTRUCTION PERMIT TRANSFERS
Dear Mr. McCollum:
By letter dated November 13, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18318A428), Nuclear Development, LLC (ND) submitted an application requesting that the U.S. Nuclear Regulatory Commission (NRC) consent to the transfer of Construction Permits (CP) CPPR-122 and CPPR-123 for the Bellefonte Nuclear Plant, Units 1 and 2 from the Tennessee Valley Authority (TVA) to ND. In its application, ND also requested that the NRC issue conforming administrative amendments and amend the CPs to reflect the revised completion dates discussed in the application. On November 5, 2019, the NRC staff accepted and docketed NDs application for detailed review (ML19298A194). On August 28, 2023, ND submitted a letter (ML23263A100) requesting that the NRC withdraw NDs application.
In accordance with Section 2.1302, Notice of withdrawal of an application, of Title 10 of the Code of Federal Regulations, the NRC has filed the enclosed Notice of Withdrawal of Application for Approval of Direct License Transfer with the Office of the Federal Register for publication. Accordingly, the NRC staff has suspended its review of NDs application and has closed the Enterprise Project Identifier (EPID) No. L-2018-LLM-0155 associated with the review of NDs application.
