FOR TIME TO REPLY TO RESPONSES TO THEIR MOTION TO CLARIFY AIAB-123 r IN LIGHT OF THE NIAGARA MOHAWK DECISION  ;;

t Saginaw Intervenors hereby request permission to reply b to any responses filed to Saginaw Intervenors' earlier Motion to Clarify ALAB-123. In support of this request, Saginaw In- g t-tervenors state as follows:

1. Under date of November 20, 1973, Saginaw Intervenors filed a Motion to Clarify ALAB-123 in light of'.the Commission's Niagara Mohawk decision; {l

2. Under date of November 26, 1973 (ALAB-160), the Appeal Board referred this Motion to the Commission for disposition;

3. Under date of November 28, 1973, the Commission re-quested that any responses to Saginaw's Motion be filed with the Comission on or before December 10, 1973. No provision I.

i n that order permitted Saginaw Intervenors to file a reply 10, 1973; to any of the papers filed on or before December

4. Saginaw Intervenors hereby request that they be permitted a reasonable opportunity to reply to any submis-sions in connection with the pending Motion filed on December 10, 1973; 5.

In view of the fact that the Commission has granted i ,

those parties who may oppose the Motion ,a period of almost two weeks to respond (November 28 to December 10), and in view of the importance of this issue, Saginaw Intervenors believe that a like period be accorded Saginaw Intervenors for time to reply.

Such a time request is reasonable under all the circumstances and in view of the potential delay in mailing during the holiday season.

WHEREFORE , Saginaw Intervenors request that they be per-1973 mitted to reply to any responses filed on December 10, and that such reply be permitted on or before December 24, I
