DOCKET NO. 50/395 OPERATING LICENSE NO. NPF-12 LICENSE CONDITION 2.C(5) 14-DAY REPORT ON EXCEEDING SURVEILLANCE FREQUENCY South Carolina Electric & Gas Company (SCE&G) is submitting this report in accordance with the requirements of Virgil C. Summer Nuclear Station Operating License Condition 2.C(5). The License Condition requires that a surveillance to verify the stability of the west embankment and its effects on the intake structure of the Service Water pond be performed at a frequency not to exceed 5 years.
Contrary to this requirement, the plant has exceeded the surveillance interval due to the misapplication of the 25% grace period typically applied to Technical Specification surveillances. The application of this grace period resulted in the year 2000 surveillance being performed 5 mzonths late and due to a lack of resources the surveillance scheduled for January 2006 has not been performed as of this date.
Following discovery that the surveillances have exceeded the 5 year interval, Engineering reviewed the horizontal and vertical alignment survey data that has been collected since construction for these structures to confirm that there has not been an adverse trend developing. In addition, Engineering annual inspections of the Service Water Pump House and dams for erosion, weed growth, cracks and other deterioration found no evidence of structural distress. This review of historical data and visual inspections (most recent performance was July 21, 2006) concluded that all structures, dams and embankments continue to be operable and capable of performing their nuclear safety related function.
Corrective actions being taken to re-establish compliance with License Condition 2.C(5) include:
0 Civil Maintenance will perform the overdue survey by February 2007. The results will be provided to Engineering for evaluation in accordance with the program guidance.

- The surveillance tasks will be changed to prevent any future extension that would violate the 5 year frequency of the Operating License.
