60-Day Written Report in Accordance with 10 CFR 71.95(c)

Abstract 10 CFR 71.95(c)(1)

BWX Technologies, Inc., Nuclear Operations Group, Lynchburg facility (BWXT NOG-L) is providing this sixty-day written report in accordance with 10 CFR 71.95(c). The report is required for "instances in which the conditions of approval in a Certificate of Compliance were not observed in making a shipment per 10 CFR 71.95(a)(3)."

The USN5797/B(U)F is used to ship the Inner and Outer unirradiated fuel elements to Y-12 or ORNL in Oak Ridge, Tennessee. The container has a tie-down band to assist with the securing of the container in the transport vehicle.

On March 25, 2022, ORNL notified BWXT, as a registered user for the 5797 package, that an error was discovered on drawing M-20978-EL-00BE regarding the shackle size and configuration for the tie down band. ORNL stated they were working to resolve the error with the DOE and the NRC, but to not ship the packages until further notice.

Narrative 10 CFR 71.95(c)(2)

BWXT NOG-L has shipped HFIR elements to ORNL and Y-12 in these containers for over 25 years.

BWXT was notified that the "as-built" Tie Down Band (TDB) did not match the licensing drawing M-20978-EL-00BE. BWXT placed the containers on hold until the NRC issued an amendment letter dated April 15, 2022 allowing shipments to continue through January 31, 2023.

Investigation and Assessment of Safety Consequences 10 CFR 71.95(c)(3)

Investigation There was no investigation by BWXT NOG-L since the error was a nonconformance of the "as-built" TDB hardware configuration and components with respect to the licensing drawings referenced in the Certificate of Compliance (CoC) no. 5797, Rev. 22 (Docket 71-5797).

Safety Assessment No components or systems failed.

The TDB does not affect the safety of the container. It is used to help secure the container in the transport vehicle.

Corrective Actions 10 CFR 71.95(c)(4)

Actions Taken Corrective Action CA202200594 was initiated and the BWXT NOG-L NRC Resident Inspector was contacted to report the event once it was deemed reportable.

Planned Corrective Actions Nuclear Materials Control (NMC) Transportation Administration has a commitment to ensure the licensing drawing is updated and approved by the NRC or prepare to stop shipments utilizing the HFIR container until the NRC has approved the new CoC.

Commitment Date: December 16, 2022 with a note to follow-up mid January, 2023 if necessary.
