Dear Mr. Slater:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated March 21, 2023 (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML23100A162). In the letter, you shared your concerns regarding potential discharge of liquid effluent from Indian Point Nuclear Power Plant (Indian Point) by Holtec Decommissioning International, LLC (Holtec) into the Hudson River, and urged the NRC consider enhanced standards for the decommissioning of nuclear power plants.
As noted in your letter, the controlled release of liquid effluents at nuclear power plants, within specified regulatory limits, is an activity that occurs throughout the operation and decommissioning of a facility. The NRCs regulations and licensing reviews for the facility consider such releases as part of the agencys safety and environmental determinations, ensuring that it is safe for people and the environment. The NRCs regulations and conditions in the license issued to Holtec for Indian Point require Holtec to ensure that the releases of gaseous and liquid effluents meet the applicable NRC and U.S. Environmental Protection Agency requirements.
The NRC inspects the actions and the records of its licensees to ensure that compliance with environmental radiation standards is maintained. Further, licensees are required to have an environmental monitoring program that includes environmental sampling and to submit an annual report to the NRC. Your letter also urges the NRC to consider enhanced standards for the decommissioning of nuclear power plants. The NRC published a proposed rule entitled, Regulatory Improvements for Production and Utilization Facilities Transitioning to Decommissioning (NRC-2015-0700), on March 3, 2022. The public comment period for the proposed rule closed on August 30, 2022, and the NRC is currently considering the comments it received in preparation of the final rule.
In accordance with Title 10 of the Code of Federal Regulation Section 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
