Victor, Attachments, totalling 2 pages, are being withheld in its entirety under FOIA Ex. 4 I appreciate you and your staff members meeting with us on January 23rd to discuss the Bellefonte Nuclear project, the purchase of the Bellefonte Nuclear site by Nuclear Development, LLC (ND) and our plans to apply for transfer of the Construction permits from TVA to ND.

Following a successful transfer of the permits from TV A to ND we intend to proceed with submitting our Operating License application under 10 CFR Part 50 and plan to restart construction activities, following successful satisfaction of all regulatory requirements.

Per your request, attached are two documents relating to the project schedule and resource plans.

The first is a time line of major project milestones, the second is a bar graph indicating our plans for ramping up construction resources to complete units l & 2. I hope this provides NRC with the information you need to begin to plan for resources to support the Bellefonte project. Please let me know if you have any questions on these attachments.

Realizing that in these matters more detail is always welcome, I will send you more detailed timeline and resource information as soon as it is available. In the meantime, please don't hesitate to reach out to me if there are any questions or concerns related to the project.

Mr Mccollum, The purpose of this email is to followup on our discussion last week the setting up of a system as ND, LLC, for storing, handling, and transmitting sensitive unclassified, security-related, and safeguards information.

SRI must be designated by one* of the agencies with that authority. This is usually DOE for reactors. You can have the submitter submit all sensitive information except SGI to you using the "SAFE" application (see YA-17-0068).

The process for sending SGI involves using digital certificates to encrypt the information on a computer authorized to process SGI such that only the recipient can decrypt it. The encrypted file is then transferred using removable media to an Internet connected computer and emailed to the recipient. The recipient places the encrypted file on removable media and transfers the file to a computer authorized to process SGI before decrypting the file.

I believe that the NRC's authority to control this information is authorized in 42 USC 2201(b),

unless I am mistaken on the subsection.

I have attached all the current guidance related to these topics.

I believe that this is the beginning of a conversation on this issue and hope that you find this information to be useful.

Victor, I appreciate you and your staff members meeting with us on January 23rd to discuss the Bellefonte Nuclear project, the purchase of the Bellefonte Nuclear site by Nuclear Development, LLC (ND) and our plans to apply for transfer of the Construction permits from TVA to ND. Following a successful transfer of the permits from TV A to ND we intend to proceed with submitting our Operating License application under 10 CFR Part 50 and plan to restart construction activities, following successful satisfaction of all regulatory requirements.

Per your request, attached are two documents relating to the project schedule and resource plans. The first is a time line of major project milestones, the second is a bar graph indicating our plans for ramping up construction resources to complete units 1 & 2. I hope this provides NRC with the information you need to begin to plan for resources to support the Bellefonte project. Please let me know if you have any questions on these attachments.

Realizing that in these matters more detail is always welcome, I will send you more detailed timeline and resource information as soon as it is available. In the meantime, please don't hesitate to reach out to me if there are any questions or concerns related to the project.

All, I received a call from Tim Matthews from Morgan Lewis late last week requesting an in-person lawyer-to-lawyer meeting to discuss the Bellefonte construction permit transfer. Nuclear Development received the staff's non-acceptance letter requesting additional information and would like to discuss two separate legal issues with us.

First, Tim would like to discuss the license condition for the technical qualifications review. He understands it is the applicant's burden to propose the condition, but would like OGC's thoughts on whether such a condition is even viable before starting the process of submitting a Commission paper (similar to the Financial qualifications license condition for new reactors). Second, Tim would like to discuss whether tlhe NRC needs a court order or TVA's con transferre. (b)(5)

As you may know, NOC has been coordinating with DOE on a request for a loan guarantee to support completion of construction at Bellefonte. Mr. Mccollum said they are "in the final throes" of receiving approval. He said that DOE, the White House and NOC are coordinating _the messages for their respective news releases on the approval of the loan guarantee.

After it receives the loan guarantee, Mr. Mccollum said that NDC plans to reengage NRC in discussions to prepare licensing submittals to support transfer of the permit to construct Bellefonte from TVA to NDC, and to extend the construction permit.

Finally, Mr. Mccollum informed me that the Daily Crawler, a DC based news and opinion website, plans to Issue an article about NOC and that, to support the article, the reporter would likely contact NRC to obtain information about the licensing process under Part SO vs Part 52.
