As you may know, NOC has been coordinating with DOE on a request for a loan guarantee to support completion of construction at Bellefonte. Mr. Mccollum said they are "in the final throes" of receiving approval. He said that DOE, the White House and NDC are coordinating.the messages for their respective news releases on the approval of the loan guarantee.

After it receives the loan guarantee, Mr. McCollum said that NDC plans to reengage NRC in discussions to prepare licensing submittals to support transfer of the permit to construct Bellefonte from TVA to NOC, and to extend the construction permit.

Finally, Mr. McColl um informed me that the Daily Crawler, a DC based news and opinion website, plans to issue an article about NOC and that, to support the article, the reporter would likely contact NRC to obtain information about the licensing process under Part 50 vs Part 52.

Official Use Only - Sensitive Internal Information TAB2 CURRENT ISSUES Bellefonte Nuclear Plant The Franklin Haney Company is in the process of purchasing Bellefonte Nuclear Plant from the Tennessee Valley Authority. This was announced in a press release from Nuclear Development on November 14, 2016. Current plans are to license Bellefonte under 10 CFR Part 50. AREVA, Inc., formerly AREVA NP, Inc. (both hereafter AREVA) will serve as the NSSS vendor. AREVA has not been in contact with NRR regarding these early stage plans and there is currently no NRR project management assigned.

Dated April 9, 2010, the Tennessee Valley Authority submitted a letter detailing their regulatory assumptions for the possible completion of Bellefonte Nuclear Plant Unit 1. This letter is included in the supplementary information.

Dated August 4, 2010, the staff responded to Tennessee Valley Authority's letter. This response is included in the supplementary information.

EPR and Other Designs On December 11, 2007, AREVA submitted an application for standard design certification for the U.S. EPR. By letter dated February 25, 2015, AREVA requested that the U.S. Nuclear Regulatory Commission suspend its safety review of the U.S. EPR design certification application. AREVA has no immediate plans to ask for further review of the U.S. EPR design.

AREVA continues to work with the Department of Energy, NEI, and EPRI on advanced reactor initiatives. They are working on a high temperature gas-cooled reactor design. They are also working with NEI and EPRI on advanced reactor design criteria. They have no immediate plans for submitting anything for staff review.

Gary has acquired over 30 years of management and engineering experience in the United States nuclear industry.

Major projects included numerous steam generator replacements, reactor vessel head repair and replacements and reactor vessel and pressurizer repairs.

In addition, Gary served a one-year assignment at the lnstitue of Nuclear Power Operations (INPO) where he was a Senior Evaluator and conducted comprehensive plant evaluation for the maintenance and wOf1< management area. More recently, he completed a one-year assignment at the Nuclear Energy lnstitue (NEI) to,provide expertise for lhe second license renewal, digital l&C and used fuel management projects.

Following a successful transfer of the permits from TV A to ND we intend to proceed with submitting our Operating License application under 10 CFR Part 50 and plan to restart construction activities, following successful satisfaction of all regulatory requirements.

Per your request, attached are two documents relating to the project schedule and resource plans.

The first is a time line of major project milestones, the second is a bar graph indicating our plans for ramping up construction resources to complete units l & 2. Mr Mccollum, The purpose of this email is to followup on our discussion last week the setting up of a system as ND, LLC, for storing, handling, and transmitting sensitive unclassified, security-related, and safeguards information.

SRI must be designated by one of the agencies with that authority. This is usually DOE for reactors. You can have the submitter submit all sensitive information except SGI to you using the "SAFE" application (see YA-17-0068).

The process for sending SGI involves using digital certificates to encrypt the information on a computer authorized to process SGI such that only the recipient can decrypt it. The encrypted file is then transferred using removable media to an Internet connected computer and emailed to the recipient. The recipient places the encrypted file on removable media and transfers the file to a computer authorized to process SGI before decrypting the file.

I believe that the NRC's authority to control this information is authorized in 42 USC 2201 (b ),

unless I am mistaken on the subsection.

I have attached all the current guidance related to these topics.

I believe that this is the beginning of a conversation on this issue and hope that you find this information to be useful.

Official Use Only - Sensitive Internal Information TAB2 CURRENT ISSUES Bellefonte Nuclear Plant The Franklin Haney Company is in the process of purchasing Bellefonte Nuclear Plant from the Tennessee Valley Authority. This was announced in a press release from Nuclear Development on November 14, 2016. Current plans are to license Bellefonte under 10 CFR Part 50. AREVA, Inc., formerly AREVA NP, Inc. (both hereafter AREVA) will serve as the NSSS vendor. AREVA has not been in contact with NRR regarding these early stage plans and there is currently no NRR project management assigned.

Dated April 9, 2010, the Tennessee Valley Authority submitted a letter detailing their regulatory assumptions for the possible completion of Bellefonte Nuclear Plant Unit 1. This letter is included in the supplementary information.

Dated August 4, 2010, the staff responded to Tennessee Valley Authority's letter. This response is included in the supplementary information.

EPR and Other Designs On December 11, 2007, AREVA submitted an application for standard design certification for the U.S. EPR. By letter dated February 25, 2015, AREVA requested that the U.S. Nuclear Regulatory Commission suspend its safety review of the U.S. EPR design certification application. AREVA has no immediate plans to ask for further review of the U.S. EPR design.

AREVA continues to work with the Department of Energy, NEI, and EPRI on advanced reactor initiatives. They are working on a high temperature gas-cooled reactor design. They are also working with NEI and EPRI on advanced reactor design criteria. They have no immediate plans for submitting anything for staff review.

AREVA is also considering a modified EPR design for future deployment in Europe. AREVA has no current plans for submitting this design for certification in the U.S.

Gary has acquired over 30 years of management and engineering experience in the United States nuclear industry.

Mr. Peters began his career as a nudear trained submarine officer on the USS Will Rogers (SSBN 659). He continued his Navy career in the US Navy Reseve supporting submarine operations around the wor1d, induding Operation Enduring Freedom anti-terrorist strikes, the Bosnia/Kosovo conflict and Chief of Naval Operations special programs. In 1988, Gary joined the Babrodc and Wilcox Company, in Lynchburg, VA, where he was the Project Manager who developed and delivered steam generator chemical cleaning and waste processing sevices to the industry. He received two patents in this area.

During his career with AREY A, he has managed various areas including Navy inspection programs, outage and Nondestructive Examination Services, Stragegic Plaming, Nuclear Service Project Management, VP Component Repair and Replacement and Corporate VP Safety, Quality and Perfomance Improvement.

Major projects included numerous steam generator replacements, reactor vessel head repair and replacements and reactor vessel and pressurizer repairs.

In addition, Gary served a one-year assignment at the lnstitue of Nuclear Power Operations (INPO) where he was a Senior Evaluator and conducted comprehensive plant evaluation for the maintenance and wOf1< management area. More recently, he completed a one-year assignment at the Nuclear Energy lnstitue (NEI) to,provide expertise for lhe second license renewal, digital l&C and used fuel management projects.

Dear Mr. Bhatnagar:

This is in response to Tennessee Valley Authority's (TVA's) letter of April 9, 2010, regarcing key reguatory assumptions l.llderlying the possible reactivation and completion of ooostruction of the unfinished Bellefonte Nuclear Plant (BLN) Units 1 and 2.

In 1988, TVA suspended construction of two Babcodt and Wilcox (B&W} pressurized-watll.1" reactOfS, BLN Units 1 and 2. At that time, TVA inplemented a layup program to preseNe the con<ition of the plant. In the earty 2000s, TVA began reducing the oomber of maintenance and preservation activities at BLN. In 2006, TVA requested that the U.S. Nuclear Regulalofy Commission (NRC) withdraw the construction permits (CPs) klr BLN Units 1 and 2, and the NRC granted this request. In 2008, TVA aslled the NRC to reinstate its previously withdrawn CPs for BLN Units 1 and 2 Subsequently, on Marth 13, 2009, the NRC granted TVA's request and reinstated the CPs, placing BLN Units 1 and 2 il "temlinated plant" status under the Commission's Policy Statement on Deferred Plants (NRC Generic Letter 87-15, 'Policy Statement on Deferred Plants," dated November 4, 1987, and pubished in the Federal Register as 52 FR 38077, dated October 14, 1987); hereinafter referred to as the policy statement On January 14, 2010, the NRC authorized BLN Units 1 and 2 to be placed il 'deferred plant" status.

In continuation of its efforts to assess the feasibiity of reactivating construction at BLN Units 1 and 2, on April 9, 2010, TVA provkied the NRC with a summary of key regulalofy assumptions klr the possille reactivation and completion. TVA has proposed fc:u key assumptions for reactivating BLN Units 1 and 2 and requested an NRC response to them. The NRC's response is discussed below.

Approach for Review of Revised Operating License (Ol) Application In its Apri 9, 2010, letter, TVA stated it was studying the possible reactivation and c~

of a KlQle BLN B&W 1.11il H TVA's Board of Directors authorizes the reactivation of construction fof one B&W unit, TVA plans to swnit a revised operalslg license (Ol.) application for both BLN Units 1 and 2 pc.nuant to TIiie 10 of !he Code of Federu/ ReQUlations (10 CFR) Part 50, "Oomest:ic Licensing of Production and Utilization Facilities." TVA proposes that NRC licensing reviews be performed for both BLN Urits 1 and 2, whie its construction efforts would be applied to a single B&W unit.

This ~oach is acceptable to the NRC. Accordingly, the Office of Nu dear Reactor Regulation (NRR), which is responsille for icensing faclities t.11der 10 CFR Part 50, wil penoon the ticensing review for both BLN Units 1 and 2. The NRC wil not make any final conclusion on the OL application for the unfinished second unit. TVA would need to ad~ the items in the poicy statement should it elect to reactivate construction of Unit 2. Region II will be re$pOnSible for inspection of construction, with assistance from NRR. (The Office of New Reactors is responsible for licensing new reactors under 10 CFR Part 52, "Licenses, Certifications., and Approvals for Nuclear Power Plants," and wil manage the review of BLN Units 3 and 4; this review is currently in progress.)

Approach to Ad<tess Tempora,y Cessation of Quality Assurance (OA) Pf0!1llffl The absence of preservation and maintenance, the cessation of the 0A program, and the conduct of investment recovery activities at BLN Units 1 and 2 during the period from withdrawal of the CPs in 2006 t.11bl the CPs were reinstated in 2009, renders the material condition of structtres, systems, and components (SSCs) indeterminate. To adcress this disconoouity in OA, TVA plans to develop and implement a recovery program, which will include verification of QA reeords, design baseline (Le., physical condition/configt.ntion assessment, licenmg verification, and design basis verification), and replacement items. TVA states that it wil submit the recovery program for the NRC's review and approval before the reactivation of coostruotion activities. Finalzation of the BLN design would folow recovery program awroval, with full implementation of the program OCClll'ing before the completion of construction. Recovery program actiYffies undertaken during the period of deferral would be controlled to ensure compliance with the Policy statement on Deferred Plants and the current TVA 0A program.

TVA states that successfu implementation of the approved recovery l)ro!1'8m would adequately address the ac!Verse impacts from the temporary cessation of the QA program at BLN Units 1 and 2.

The staff recognizes that a comprehensive and rigorous recovery program would be necessary to restore and demonstrate the quality of SSCs. However, the staff has no basis to determine the acceptabiity of the reeovery program to restore quaity until TVA subrms the program and the staff completes its review. The staff wil review the recovery program, inspect the implementing procedures, and inspect implementation of the reoovery program to ensure that it includes necessary elements, is comprehensive, and adequately demonstrates that SSCs will meet their design and performance standards as desaibed in the final safety analysis report The staff expects TVA to replace, refut>ish, or othelwise appropriately address any SSCs that fai to meet the specified requirements.

Approach on New Regulatory Reql.irements TVA plans to review the new regulatory requirements for applicability to BLN lklits 1 and 2.

Through this review, TVA wiJI address the elements of NUREG-O&JO, "Standard Review Plan for the Review of Safety Analysis Reports for Nudear Power Plants: LWR [light-Water ReactorJ E<fltion," and NUREG-1555, "Standard Review Plans for Environmental Reviews for Nuclear Power Plants: Environmental standard Review Plan for New SiteJPl!wlt Applications," as they apply to the licensing and design of BLN Units 1 and 2. TVA also stated that it would seek opportunities to improve plant systems and design as part of this review.

Consistent with the policy statement, the staff wil apply licenSSJg standards in the same manner as when reviewing plants tnder active construction. As provided in the policy statement, any new staff positions will be applled to BLN Units 1 and 2 subject to 10 CFR S0.109, "Backfdtslg,"

reqlirements. However, regWttions that have applicability provisions built into them wil be applied to BLN Units 1 and 2 without the use of the backfit rule taking into account the date of the original CP issuance and the existing OL application. If cases are identified where the current Yer.lion of the Standard Review Plan addresses reqi..-ements or criteria not applicable to BLN Units 1 and 2., the staff wiD refer to the previous versions for guidance. The staff will also consider any alternative approaches to meeting regulatory requirements that TVA may propose.

Cootrol of Activities Prior to Construction Reactivation TVA intends to perform walkdowns of plant SSCs and other activities necessary to further develop the licensing and engineering baseline, reestablish plant configuration control, address the preservice condition of sses, and prepare for any construction reactivation. TV A states that these activities will be controlled to avoid conslruction as described in 10 CFR 50.10, "License Required; Limited Work Autholizatia1." TVA plans to carry out these activities under an NRC-apprOlled QA program tor BLN Units 1 and 2.

The staff believes that the term"construction," as defined in 10 CFR 50.10 is intended to address the work that can be performed wilhout a CP but under a imited work authorization..

The staff detemwned that plant walkdown and configuration control activities are not considered construction activities and, therefore, can be performed prior to the 120-<lay staff notification as specified in the policy statemeot. TVA should develop adequate procedures to ensure that WOf1I activities performed at BLN during this period would only determine the current status of SSCs and do not further plant construction or completion. Under the policy statement, a desaiption of the planned activities and procedlrlll controls should be inckJded il the QA program, which woud be reviewed and apprO\led by the NRC in accordance with 10 CFR 50.54{aX3),

Appendix B to 10 CFR Part 50, and inspection procedures as appropriate. Further, TVA should not engag.e in any work activities that would preclude the NRC from identifying SSCs that may reqtire special attention or pertormilg inspections to verify that SSCs meet their quality and performance requirements.

Bob, I have been assigned a briefing package for a drop-in by AREVNNuclear Development LLC. I don't know why. They are discussing Bellefonte (which will be part 50 no part 52, so NRR not NRO). Background

Construction Permits and Site Status In 1988, Tennessee Valley Authority (TVA) deferred construction of BLN Units 1 and 2, (two Babcock & Wilcox Model 205 PWRs) due in part to lower-than-expected electrical load forecast in its service area. Unit 1 was about 90% complete and Unit 2 was about 58% complete at the time of the deferral. In 2006, at TVA's request, the NRC withdrew the CPs. In August 2008, TVA requested that the NRC reinstate the CPs to allow TVA to determine the viability of completing the units.

On February 18, 2009, the Commission issued its SRM (COMSECY-08-0041) authorizing the Director of NRR to issue an order reinstating the CPs and placing the BLN units in "terminated" status, rather than the "deferred" status that TVA sought. On March 9, 2009, the NRC reinstated the CPs and placed the units in "terminated" status. Subsequently, on January 14, 2010, the NRR Director authorized TVA's August 10, 2009, request to place the plants in "deferred" status after determining, by review and inspection, compliance with the Commission's policy statement on deferred plants.

On October 8, 2010, TVA submitted a request to extend construction permit CPPR-122 for BLN Unit 1 from October 1, 201 1, to October 1, 2020. On September 1, 2011, TVA informed the NRC of its decision to complete construction and seek eventual commercial operation of BLN Unit 1. TV A also stated that it would resume construction activities associated with BLN Unit 1, only after the initial loading of fuel at Watts Bar Nuclear Plant (WBN) Unit 2. On September 30, 2011, the NRC issued an order extending the completion date of Construction Permit No.

CPPR-122 (BLN Unit 1) from October 1, 2011 to October 1, 2020. On June 12, 2013 TVA announced a reduction of funding for BLN Unit 1 in FY14 in order to redirect resources to the completion of WBN Unit 2.

On June 10, 2014 TVA submitted a request to extend the construction permit for BLN Unit 2 from October 1, 2014 to October 1, 2017. Given the uncertainty in TV A's future plans for BLN, the NRC staff, after consultation with TVA, decided to defer review of the request to extend the BLN Unit 2 construction permit until the results of TVA's Integrated Resource Plan (IRP) were published. The permit remains valid per the timely renewal clause of 10 CFR 2.109.

Auction of Bellefonte Site In August 2015, TVA's Board of Directors approved the TVA 2015 Integrated Resource Plan, which stated that there was no immediate need for new base load plants after completion of WBN Unit 2 and completion of uprates at the Browns Ferry Nuclear Plant.

In February 2016, TVA sought public comment on the future of the BLN site, including whether the site should be sold for productive use. In May 2016, TV A announced that it would put the BLN site up for auction. On November 14, 2016, TVA announced the sale of the BLN property to Nuclear Development, LLC for $111 million. Nuclear Development, LLC, announced its plans to complete construction and commence operation of the BLN units. The sales agreement provides for a 2-year timeframe for TVA and Nuclear Development, LLC, to close on the property. TVA will maintain the site until the sale is closed.

Official Use Only - Sensitive Internal Information Licensing Considerations Status of Construction Permits (Extension and Transfer)

The current deferred request to extend the BLN Unit 2 CP would need to be supplemented, as the reasons proposed by TVA for its extension have been superseded by the sale of the site.

The staff is unsure as to whether TVA plans to request a new extension. Alternatively, an extension could be included as part of a request to transfer the CPs to Nuclear Holdings, LLC, in accordance with 10 CFR 50.80.

Potential Challenges Level of TVA Support for CP Transfer to New Owner Based on informal interactions with TVA management to date, the level of TVA's support for licensing actions necessary to extend and/or transfer the CPs to the new owner is unclear.

Applicant Qualifications An application for transfer of a permit is required by 10 CFR 50.80(b) to include as much of the technical and financial qualifications information on the proposed transferee as would be required for an initial license application. The NRC staff has had no communication with Nuclear Development, LLC, and is unsure of its technical and financial qualifications to be a holder of a construction permit or applicant for an operating license, or its level of knowledge of the NRC's licensing processes.

Resources In its press statements, Nuclear Development, LLC, has stated that it plans on starting work on the BLN site in 2017. There is no FTE or contract funding assigned in the FY 2017 or FY 2018 budgets to the BLN project for development of licensing and inspection infrastructure, conduct of safety or environmental reviews, or conduct of inspections.

Resource estimates would need to be developed, and could be informed by data related to the Watts Bar 2 OL review and, to some extent, by data related to new reactor design certification and COL reviews. Data compiled regarding the Watts Bar 2 OL review indicates charges to the applicant from re-initiation of the licensing review through inspection of pre-operational and power ascension testing (approximately a 9-year time frame) totaled approximately $51 million.

While some fraction of these charges represent contract support, at current 10 CFR Part 170 hourly rates, this equates to approximately 192,000 staff-hours, or 135 FTE. In light of the more advanced state of completion of Watts Bar 2 relative to the Bellefonte units, and the fact that many of the Watts Bar 2 licensing review topics had been addressed as part of the Watts Bar 1 OL review, the resources necessary to complete reviews and inspections necessary to support licensing decisions for the Bellefonte units could reasonably be expected to potentially be substantially greater.

Licensing Infrastructure As noted under Resources, above, similar to the review of the WBN Unit 2 operating license application recently completed, there may be a need for supplemental guidance regarding review and inspection of construction activities or an operating license application.

Official Use Only - Sensitive Internal Information Potential Policy Issues Organizational Responsibility for Licensing Review The staff had previously determined that, as the office responsible for licensing facilities under 10 CFR Part 50, the Office of Nuclear Reactor Regulation (NRR), would perform the licensing review for the BLN units (see letter from Director, NRR, to TVA dated August 4, 2010, ADAMS Accession No. ML101880337). Senior management and the Commission may re-evaluate this decision in light of the pending merger of NRR and the Office of New Reactors.

Potential for New Construction Permit Application As discussed under Potential Challenges above, depending on TVA's level of support for transfer of the CPs to the new owner, Nuclear Development, LLC, may need to submit an application for new CPs to complete construction of the facility. The staff would need to assess the current requirements of 10 CFR Part 50 and any policy implications arising from the age of the facility design and the existing plant condition.

SRI must be designated by one of the agencies with that authority. This is usually DOE for reactors. You can have the submitter submit all sensitive information except SGI to you using the "SAFE" application (see YA-17-0068).

The process for sending SGI involves using digital certificates to encrypt the information on a computer authorized to process SGI such that only the recipient can decrypt it. The encrypted file is then transferred using removable media to an Internet connected computer and emailed to the recipient. The recipient places the encrypted file on removable media and transfers the file to a computer authorized to process SGI before decrypting the file.

I believe that the NRC's authority to control this information is authorized in 42 USC 2201 (b ),

unless I am mistaken on the subsection.

OFFICIAL USE ONLY - SENSITIVE INTERNAL INFORMATION CURRENT ISSUES Bellefonte Nuclear Plant Construction Status, Sale, and Potential Completion Nuclear Development, LLC, is in the process of purchasing Bellefonte Nuclear Plant from the Tennessee Valley Authority. This was announced in a press release from Nuclear Development on November 14, 2016. Current plans are to license Bellefonte under 10 CFR Part 50. AREVA, Inc., formerly AREVA NP, Inc. (both hereafter AREVA) will serve as the nuclear steam supply system vendor.

Background

Construction Permits and Site Status In 1988, Tennessee Valley Authority (TVA) deferred construction of Bellefonte Nuclear Plant (BLN) Units 1 and 2, (two Babcock & Wilcox Model 205 PWRs) due in part to lower-than-expected electrical load forecast in its service area. Unit 1 was about 90% complete and Unit 2 was about 58% complete at the time of the deferral. In 2006, at TV A's request, the NRC withdrew the construction permits (CPs). In August 2008, TVA requested that the NRC reinstate the CPs to allow TV A to determine the viability of completing the units.

On February 18, 2009, the Commission issued its Staff Requirements Memorandum (SRM)

(COMSECY-08-0041 Agencywide Documents Access and Management System (ADAMS)

Accession Nos. ML090490838 and ML090500374) authorizing the Director of the Office of Nuclear Reactor Regulation (NRR) to issue an order reinstating the CPs and placing the BLN units in "terminated" status, rather than the "deferred" status that TVA sought. By letter dated March 9, 2009 (ADAMS Accession No. ML090610237), the NRC reinstated the CPs and placed the units in "terminated" status. Subsequently, on January 14, 2010, (ADAMS Accession No. ML093420915) the NRR Director authorized TVA's August 10, 2009 (ADAMS Accession No. ML092230730}, request to place the plants in "deferred" status after determining, by review and inspection, compliance with the Commission's policy statement on deferred plants.

By letter dated October 8, 2010 (ADAMS Accession No. ML102870233), TVA submitted a request to extend construction permit CPPR-122 for BLN Unit 1 from October 1, 2011, to October 1, 2020. On September 1, 2011 (ADAMS Accession No. ML11249A162), TVA informed the NRC of its decision to complete construction and seek eventual commercial operation of BLN Unit 1. TVA also stated that it would resume construction activities associated with BLN Unit 1, only after the initial loading of fuel at Watts Bar Nuclear Plant (WBN) Unit 2.

On September 30, 2011 (ADAMS Accession No. ML11245A128), the NRC issued an order extending the completion date of Construction Permit No. CPPR-122 (BLN Unit 1) from October 1, 2011 to October 1, 2020. On June 12, 2013 TVA announced a reduction of funding for BLN Unit 1 in FY14 in order to redirect resources to the completion of WBN Unit 2.

On June 10, 2014 (ADAMS Accession No. ML14168A489), TVA submitted a request to extend the construction permit for BLN Unit 2 from October 1, 2014 to October 1, 2017. Given the uncertainty in TVA's future plans for BLN, the NRC staff, after consultation with TVA, decided to defer review of the request to extend the BLN Unit 2 construction permit until the results of 4

The permit remains valid per the timely renewal clause of Title 10 of the Code of Federal Regulations ( 10 CFR) 2.109. By letter dated March 31, 2017 (ADAMS Accession No. ML17090A388), TVA cited the auction of Bellefonte and proposed leaving the requested extension as an open item until the staff is able to interact directly with the purchaser.

Auction of Bellefonte Site In August 2015, TVA's Board of Directors approved the TVA 2015 IRP, which stated that there was no immediate need for new base load plants after completion of WBN Unit 2 and completion of uprates at the Browns Ferry Nuclear Plant.

In February 2016, TVA sought public comment on the future of the BLN site, including whether the site should be sold for productive use (press release included in supplemental information).

In May 2016, TVA announced that it would put the BLN site up for auction (press release included in supplemental information). On November 14, 2016, TVA announced the sale of the BLN property to Nuclear Development, LLC for $111 million (press release included in supplemental information). Nuclear Development, LLC, announced its plans to complete construction and commence operation of the BLN units. The sales agreement provides for a 2-year timeframe for TVA and Nuclear Development, LLC, to close on the property. TVA will maintain the site until the sale is closed.

The NRC received draft preliminary resource and schedule information from Mr. William McCollum on February 1, 2017 (see pages 22, 23).

Licensing Considerations Status of Construction Permits (Extension and Transfer)

The current deferred request to extend the BLN Unit 2 CP would need to be supplemented, as the reasons proposed by TVA for its extension have been superseded by the sale of the site.

The staff is unsure as to whether TVA plans to request a new extension. Alternatively, an extension could be included as part of a request to transfer the CPs to Nuclear Holdings, LLC, in accordance with 10 CFR 50.80.

Potential Challenges Level of TVA Support for CP Transfer to New Owner Based on informal interactions with TVA management to date, the level of TV A's support for licensing actions necessary to extend and/or transfer the CPs to the new owner is unclear.

Applicant Qualifications An application for transfer of a permit is required by 10 CFR 50.80(b) to include as much of the technical and financial qualifications information on the proposed transferee as would be required for an initial license application. The NRC staff has had no communication with Nuclear Development, LLC, and is unsure of its technical and financial qualifications to be a holder of a construction permit or applicant for an operating license, or its level of knowledge of the NRC's licensing processes.

OFFICIAL USE ONLY - SENSITIVE INTERNAL INFORMATION Resources In its press statements, Nuclear Development, LLC, has stated that it plans on starting work on the BLN site in 2017. There are no FTE or contract funding assigned in the FY 2017 or FY 2018 budgets to the BLN project for development of licensing and inspection infrastructure, conduct of safety or environmental reviews, or conduct of inspections.

Resource estimates would need to be developed, and could be informed by data related to the Watts Bar 2 operating license (OL) review and, to some extent, by data related to new reactor design certification and COL reviews. Data compiled regarding the Watts Bar 2 OL review indicates charges to the applicant from re-initiation of the licensing review through inspection of pre-operational and power ascension testing (approximately a 9-year time frame) totaled approximately $51 million. While some fraction of these charges represent contract support, at current 10 CFR Part 170 hourly rates, this equates to approximately 192,000 staff-hours, or 135 FTE. In light of the more advanced state of completion of Watts Bar 2 relative to the Bellefonte units, and the fact that many of the Watts Bar 2 licensing review topics had been addressed as part of the Watts Bar 1 OL review, the resources necessary to complete reviews and inspections necessary to support licensing decisions for the Bellefonte units could reasonably be expected to be substantially greater.

Licensing Infrastructure As noted under Resources, above, similar to the review of the WBN Unit 2 operating license application recently completed, there may be a need for supplemental guidance regarding review and inspection of construction activities or an operating license application.

Potential Policy Issues Potential for New Construction Permit Application As discussed under Potential Challenges above, depending on TVA's level of support for transfer of the CPs to the new owner, Nuclear Development, LLC, may need to submit an application for new CPs to complete construction of the facility. The staff would need to assess the current requirements of 10 CFR Part 50 and any policy implications arising from the age of the facility design and the existing plant condition.

Mignogna joined AREVA in 1981, after sta,ting his career at Babcock & Wilcox in 1977, where he performed hydraulic and structural engineering analyses for new nuclear plant designs and modifications to existing plants.

With AREVA, Mignogna has built a body of experience in engineering design and analyses, project engineering, product management, field services, services tooling and equipment design, component and welding engineering, business development, and product line management.

Mignogna has consistently demonstrated a strong commitment to Operational Excellence through a number of initiatives launched under his leadership. He started AREVA's Engineering qualification program - modeled after INPO's program - and is the founding sponsor of the Voyager rotational program for up-and-coming leaders in engineering. In addition, the U.S. region was the first to implement a new global project management certification program to further drive a shared culture of safe, quality, on-time project delivery and perfom1ance for AREVA's customers.

He was appointed Vice President of Component Replacement & Repair in 2000, Vice President of Engineering for Operating Plants in 2006, Vice President of the Operating Plants business units in 2008, Vice President and U.S. Regional Deputy for Engineering in 2010, and was named Senior Vice President of the Engineering & Projects U.S. business group in 2012. Additionally, Mignogna is on the Boards of AREVA Inc., AREVA Federal Services, Canben-a Inc., SGT West JV (an AREVA and AECOM company), and ADZ N (an AREVA and Day & Zimmermann company).

Mignogna has been a member of the Nuclear Strategic Issues Advisory Committee since 2007, a member of Nuclear Energy Institute's Materials Executive Oversight Group from 2003 to 2009, and on the Industrial Advisory Board of Old Dominion University's Applied Research Center for Lasers and Plasmas for Advanced Manufacturing (in conjunction with the National Science Foundation) from 2002 to 2005. He is cun-ently a member of the Nuclear Energy Institute Board of Directors, Executive Committee, and Nominating Committee.

He has also held numerous positions on church and school non-profit boards, and is cun-ently on the University of North Carolina Charlotte's Lee College of Engineering Leadership Academy Advisory Board and the Board of Trustees of the Academy of Pine Arts in Lynchburg, Virginia.

Mignogna earned Bachelor's and Master's degrees in Mechanical Engineering from Drexel University, and holds a master's degree in Business Administration from Lynchburg College.

Master of Business Administration degree from Auburn University and a Bachelor of Science degree in Chemical Engineering from Clarkson University. Ga1y has acquired over 30 years of management and engineering experience in the United States nuclear industry.

Mr. Peters began his career as a nuclear trained submarine officer on the USS Will Rogers (SSBN 659). He continued his Navy career in the US Navy Reseve supporting submarine operations around the world, including Operation Enduring Freedom anti-terrorist strikes, the Bosnia/Kosovo conflict and Chief of Naval Operations special programs. In 1988, Gary joined the Babcock and Wilcox Company, in Lynchburg, VA, where he was the Project Manager who developed and delivered steam generator chemical cleaning and waste processing sevices to the industry. He received two patents in this area.

During his career with AREY A, he has managed various areas including Navy inspection programs, Outage and Nondestructive Examination Services, Stragegic Planning, Nuclear Service Project Management, VP Component Repair and Replacement and Corporate VP Safety, Quality and Perfomance Improvement. Major projects included numerous steam generator replacements, reactor vessel head repair and replacements and reactor vessel and pressurizer repairs.

In addition, Gary served a one-year assignment at the Institue of Nuclear Power Operations (INPO) where he was a Senior Evaluator and conducted comprehensive plant evaluation for the maintenance and work management area. More recently, he completed a one-year assignment at the Nuclear Energy Institue (NEI) to provide expertise for the second license renewal, digital I&C and used fuel management projects.

Gary holds a Professional Engineer license in chemical engineering from the Commonwealth of Virginia, a Project Management Professional certification and a Radiation Safety Officer certification.

He has served as Director, Licensing & Regulatory Affairs of AREVA Inc. since December2015.

Raised in McMinn County, Tennessee, Haney grew up on a farm before working his way through the University of Tennessee (UT) as a salesman for Southwestern Publishing Company. Haney moved to Washington after graduation to work as a legislative assistant to U.S. Senator Al Gore, Sr. of Tennessee and attend the George Washington University School of Law. Capitol Hill kindled his interest in politics; upon returning to Tennessee, his involvement in politics included serving as assistant general counsel to the Tennessee Public Service Commission and making a bid for the 3rd Congressional District seat and later, a bid for the Governor's office.

OFFICIAL USE ONLY - SENSITIVE INTERNAL INFORMATION TVA Seeks Comment on Potential Sale of Bellefonte Nuclear Plant Site February 17, 2016 HOLLYWOOD, AL. - The Tennessee Valley Authority is asking the public for input on whether to sell the Bellefonte Nuclear Plant site, a 1,600-acre peninsula located on Guntersville Reservoir near Hollywood, Alabama.

In addition to a nuclear plant use, some of the site infrastructure would support different uses including industrial, commercial and residential development. The site includes:

Two partially constructed B&W pressurized light water reactors and associated facilities 500-kV and 161-kV switchyards Office buildings Warehouses A training center Parking lots Railroad spurs A helicopter landing pad 1,600 acres of land "As we consider this decision, it is important that we hear from interested stakeholders, potential site developers and the general public," said President and CEO Bill Johnson. "TVA has been investing at a minimal level to preserve the Bellefonte site for future generating use, should we need it.

"The 2015 Integrated Resource Plan, completed with public input, indicates it may be two decades before additional large baseload generation is needed," he said. "It's time we answer the question of whether TVA is serving the public well by retaining control of the Bellefonte site, or if others could make more beneficial use of it. And with economic development as a cornerstone of our mission, TVA wants to know if there is an entity interested in investing and creating jobs at this location."

A public comment period begins today and will run through March 18, 2016. Once the public notice period ends, management and the TVA Board will review the comments, along with other pertinent information, to help decide whether to sell the property. If TVA's Board of Directors declares the site surplus, TVA anticipates offering the property through a public auction process in accordance with Section 31 of the TV A Act.

The Tennessee Valley Authority's stewardship mission was the main theme of today's TV A Board of Directors meeting in Paris Landing State Park, Tenn.

"TVA's mission is to help improve the quality of life for the people of the Tennessee Valley," said TVA President and CEO Bill Johnson. "We do that by being fiscally responsible and providing low cost electricity, environmental stewardship and economic development."

Chief Financial Officer John Thomas reported that TVA has maintained healthy financials despite lower revenues. "So far this year, consumers are benefiting from mild weather and much lower costs for fuel and purchased power," he said. "We are maintaining good discipline in managing our costs, even with lower sales, and focusing on the bottom line to keep our rates low." TVA is cutting its monthly fuel cost adjustment in May to the lowest level in six years. The overall system average fuel rate is approximately 34 percent lower than the thee-year average. The lower cost is driven by recent mild weather and lower natural gas prices.

Strong financial management also includes evaluating asset needs today and in the future and making the decisions necessary to adjust for continued flat demand in electricity. At the meeting, the board voted to surplus the Bellefonte Nuclear Plant property in northern Alabama so it can be offered for sale and potentially put to better use. TVA has been preserving the property as an option for future nuclear generation. TVA's Integrated Resource Plan shows that large-scale power generation sources will not be needed for at least 20 years.

"We sought public comments on whether to sell or keep the property and for what uses," Johnson said. "Our analysis of the property and its potential uses, and input from public officials, customers and Valley residents, indicate that offering the property for sale could better serve the public." With the board's vote, TVA will now begin the process of getting the property ready for auction.

TVA serves as steward of the region's natural resources and manages 293,000 acres of land and 11,000 miles of shoreline. "The work of TVA employees in resource management makes a difference, and it's rewarding for employees and for the public," Johnson said. Since 2015, TVA employees have partnered with more than 460 groups to conduct activities on 41 reservoirs upgrading public recreation sites, enhancing habitat areas, protecting archaeological and historical sites, and conducting educational outreach efforts on the importance of protecting our natural resources.

"Our work as stewards of the region's natural resources requires us to deal with the challenging issue of how to manage the Tennessee River system and other resources to provide the greatest good for the public and for all the people we serve," Johnson said. "That question was at the heart of the study we conducted for more than two years, gathering input from owners, the public, other lake users, environmentalists, community leaders and public officials, among others, on how to address privately owned, non-navigable floating houses on TVA reservoirs."

There are approximately 1,800 of the non-navigable structures on TV A reservoirs. More than 50 percent of these do not have permits and do not meet the minimum safety and environmental standards.

In addition, the existing floating houses must be permitted and meet safety and environmental standards.

"These structures amount to a commercial development of private communities on public waters,"

Johnson said. "Like national and state parks, which prohibit private residential use of public resources, the land and water we manage are owned by the public. We have taken care to consider all perspectives on this issue, as well as the environmental and safety impacts, and believe this is the correct course of action for everyone."

During the board's External Relations Committee report, members received an update on TV A's economic development activities. So far this year, TVA has helped attract or retain 50,000 jobs and

$6.1 billion in business investments in the Valley. Johnson told the board that TVA works with customers, public officials and economic development agencies to attract good jobs to the region and retain them, help existing businesses and industries thrive, and to help Valley communities prepare for growth.

The Tennessee Valley Authority announced today the sale of the 1,400 acre Bellefonte property, near Hollywood, Ala., to Nuclear Development, LLC for the purchase price of

$111 million. The sale concludes a six-month competitive auction process designed to promote job creation and investment in northeast Alabama.

"Our primary goal in selling the site is to provide the best long-term economic return to the surrounding communities and the people of the Tennessee Valley," says Jim Chardos, TVA Bellefonte plant manager and a 22-year plant employee. "Each bidder needed to provide an end-use and investment plan to demonstrate that they can do just that -

promote economic investment in the area."

Nuclear Development, LLC proposes to complete the Bellefonte Nuclear Power Plant.

TVA set the property's minimum auction price as $36.4 million. Concentric Advisors marketed the property to more than 500 potential buyers with 11 expressing an interest and signing confidentiality agreements for further discussions. Three bidders completed Letters of Intent which included financial qualifications and a plan on how they intend to use the property.

As part of the deal, TVA requires Nuclear Development, LLC to make a $25 million minimum investment in the Bellefonte property during the five-year period following the closing. This minimum investment will promote economic development activities in Jackson County, Ala.

TV A announced the sale earlier this summer saying it no longer needed the nuclear plant site to meet future baseload power needs.

Nuclear Development, LLC has up to two years to close on the property. Until then, TVA will maintain the site.
