APPEAL PROM LICENSING BOARD DENIAL OF MOTION TO REOPEN RECORD Interveners Rorem, et al., by their undersigned attorney, hereby appeal from the decision of the Licensing Board of July 6, 1987 denying Interveners' Motion To Reopen The Record For The Purpose of Admitting a Late-Filed Contention on Financial

-Qualifications, a copy of which has previously been served upon the Appeal Board.

The basis for the Licensing Board ruling, as previously noted by this Appeal Board, was the footnote in the Commission's decision characterizing the license application as pertaining to ,

1 a "new entity". In fact, the application for amendment was filed l l

by Commonwealth Edison, the original licensee, and if granted, I l

would retain Commonwealth Edison in addition to the proposed new entity as co-licensees. For this reason, the footnote in the I Commission opinion was not complete and precise, and the basis for the Licensing Board's ruling that it lacks jurisdiction was i erroneous.

Since the Licensing Board ruling, a new development which may possibly moot the issue has arisen. On Thursday, July 16, l

the Illinois Commerce Commission rejected Edison's proposal to restructure the ownership of Braidwood. (The opinion is not yet ready; a copy of the Chicago Tribune news story on the denial is attached hereto.) If that decision stands, 'ntervenors' motion to reopen the record will be moot. However, Edison retains the right to move for reconsideration of yesterday's decision, and if such a motion were filed and granted, Interveners' motion to reopen would not be moot.

In these circumstances, Interveners propose that their Motion be taken under advisement until such time as either a final ruling is issued by the Illinois Commerce Commission in the case presently before it, or the time for filing motions for reconsideration thereof expires with no such motion having been filed by Edison or supporters of its proposal.
