APPLICANT'S MOTION TO DISMISS INTERVENOR'S CONTENTION 1(a)

OFFER OF PROOP ISSUES 3, 4, AND 6 AND CONTENTION 1(b)

Commonwealth Edison Company (Applicant) hereby files this Motion to Dismiss Intervenor's Contention 1(a) Offer of Proof Issues 3, 4, and 6 and Contention 1(b). In support of this Motion Applicant states the following:

1. Applicant received Intervenor's Proposed Findings on Emergency Planning Issues on April 24, 1986. Those Proposed Findings addressed Intervenor's Contention 1(a) (Pre-Accident Public Information) and Contention 1(a) (Offer of Proof Issue 2), but did not address Contention 1(a) (Offer of Proof Issues 3, 4, and 6) and contention 1(b).

2. Intervenor was put on notice that failure to file findings would create a default under 10 C.F.R. 5 2.754(b).

10 C.F.R. 5 2.754(b) provides:

Failure to file proposed findings of fact, conclusions of law or briefs when directed to do so may be deemed a default, and an order or initial decision may be entered accordingly.

t For the foregoing reasons, and to avoid any further unnecessary expenditure of resources by the parties and the Board, Applicant requests that the Board _ issue an Order immediately dismissing Contention 1(a) (Offer of Proof Issues 3, 4, and 6) and Contention 1(b).
